If the airplane is the only one in the sky and it reports in and says to the master bombardier on the ground, " The only thing I have on board is this," and the master bombardier still needs that fire for a lifesaving act to achieve his mission, then he would not be held liable or criminally responsible under the law for that act because it is beyond his control.
