A decision rejecting a person’s application clearly constitutes an act adversely affecting him since, in depriving him of the possibility of participating in the next phase of the recruitment procedure and, consequently, of any possibility of being appointed within the framework established by the vacancy notice, it produces binding legal effects liable directly and immediately to affect the interests of the person concerned by bringing about a distinct change in his legal position.
Une décision de rejet d’une candidature d’une personne constitue un acte lui faisant indubitablement grief puisque, en la privant de la possibilité de participer à la prochaine phase de la procédure de recrutement et, par conséquent, de toute possibilité d’être nommée dans le cadre de l’avis de vacance, il produit des effets juridiques obligatoires de nature à affecter directement et immédiatement les intérêts de la personne concernée en modifiant, de façon caractérisée, la situation juridique de celle-ci.
