IN-CONTEXT TRANSLATIONS

a.In line with the Global Approach to Migration and Mobility (GAMM) and the upcoming European Agenda on Migration, enhance HR safeguards in all migration and mobility dialogues and cooperation frameworks with third countries, including Mobility Partnerships and Common Agendas on Migration and Mobility, as well as in migration-related agreements and programmes, including through the analysis of human rights impacts; ensure the introduction of human rights training elements in capacity-building projects with immigration and border agencies.

As a severe violation of human rights mentioned in the Charter of Fundamental Rights, trafficking in human beings will continue to be covered under the Human Rights Clauses in the EU's agreements with third countries, including the Free Trade Agreements, providing the basis for cooperation on and promotion of human rights[33].

The European Community has included in the agreements it concludes a clause which makes respect for human rights, in particular as contained in the Universal Declaration on Human Rights, an essential element for its agreement to be bound.

B. On the question of Human Rights, the Agreement contains in its initial section an Article stating that relations between the Parties, as well as all the provisions of the Agreement itself, shall be based on respect for human rights and democratic principles which guide the domestic and international policies of the Contracting Parties and constitute an essential element of the Agreement.

S'agissant des Droits de l'Homme, l'accord comporte dans sa partie initiale un article stipulant que les relations entre les parties, de même que toutes les dispositions de l'accord, se fondent sur le respect des principes démocratiques et des Droits de l'homme qui inspirent les politiques internes et internationales des parties contractantes et qui constituent un élément essentiel de l'accord.

As in the case of other Community agreements with Asian countries, the parties, in the Preamble of the Agreement, reaffirm the importance which they attach to the respect for human rights and democratic principles and the principles of the United Nations Charter and the respect for national independence and sovereignty; The Agreement provides, in Article 1, that respect for human rights and democratic principles is the basis for the cooperation between the Parties and for the provisions of the Agreement, and it constitutes an essential element of the Agreement.

The agreement includes a human rights conditionality clause enabling the agreement to be suspended, even unilaterally, in the event of violation of essential components of the agreement, i.e. those upholding democratic principles and human rights and the principles of a market economy.
