3. Calls, once again, for the immediate and unconditional release of all persons detained solely for exercising their right to freedom of expression and peaceful assembly, including human rights defenders Yara Sallam and Sanaa Ahmed Seif; calls for the immediate release of human rights activist Alaa Abd El Fattah and human rights lawyer Mahinour El-Masry and the overturning of their heavy prison sentences; calls on the authorities to annul the baseless ban against the April 6 Movement and the sentences against the organization’s activists, including Ahmed Maher and Mohamed Adel;

K. whereas a large number of human rights defenders, opposition figures and youth activists have been arbitrarily arrested, charged and sentenced in relation to their peaceful activities on the basis of the Assembly Law; whereas prominent activists, such as the blogger Ahmed Douma, the April 6 leaders Mohamed Adel and Ahmed Maher, and the human rights lawyer Mahinoor El-Masry have been sentenced to three years in jail for allegedly violating this new law; whereas blogger Alaa Abd El Fattah and 24 other defendants were sentenced to a 15-year prison term for protesting without authorisation; whereas 23 persons, including human rights defenders Yara Sallam and Sanaa Ahmed Seif, were sentenced on 20 October 2014 to three-year jail sentences for breaking the anti-protest law; whereas university students have been arrested and heavily sanctioned for participating in peaceful protests on university campuses, and some of them were shot dead by police forces in university premises; whereas in all these cases, the judicial proceedings were widely denounced as politically motivated and marred by substantial procedural shortcomings;

whereas a Vietnamese lawyer and human rights activist, Lê Thu Hà, was arrested on 16 December 2015, at the same time as a prominent fellow human rights lawyer, Nguyễn Văn Đài, who was arrested for conducting propaganda against the state; whereas on 22 February 2016 human rights defender Trần Minh Nhật was attacked by a police officer at his home in Lâm Hà district, Lâm Đồng Province; whereas Trần Huỳnh Duy Thức, who was imprisoned in 2009 after a trial with no meaningful defence, received a sentence of 16 years followed by five years under house arrest; whereas there is serious concern for the deteriorating health of Buddhist dissident Thích Quảng Độ, who is currently under house arrest.
considérant que Lê Thu Hà, avocate et militante des droits de l'homme vietnamienne, a été arrêtée le 16 décembre 2015, en même temps qu'un éminent avocat des droits de l'homme, Nguyễn Văn Đài, qui a été appréhendé pour propagande contre l'État; que, le 22 février 2016, Trần Minh Nhật, défenseur des droits de l'homme, a été agressé par un officier de police à son domicile dans le district de Lâm Hà, dans la province de Lâm Đồng; que Trần Huỳnh Duy Thức, emprisonné en 2009 après un procès sans défense digne de ce nom, a été condamné à une peine de 16 ans suivie de cinq années d'assignation à résidence; que la détérioration de la santé de Thích Quảng Độ, dissident bouddhiste actuellement assigné à résidence, est source de vives préoccupations.

(7) One of the fundamental features of a fair trial, as stated by the European Court of Human Rights ("ECtHR") is that everyone charged with a criminal offence is effectively defended by a lawyer, assigned officially if need be.

In this context, regard should be had to the case-law of the European Court of Human Rights, which has established that the rights of the defence will, in principle, be irretrievably prejudiced when incriminating statements made during police interrogation without access to a lawyer are used for a conviction.

In doing so, it promotes the application of the Charter, in particular Articles 4, 6, 7, 47 and 48 thereof, by building upon Articles 3, 5, 6 and 8 ECHR, as interpreted by the European Court of Human Rights, which, in its case-law, on an ongoing basis, sets standards on the right of access to a lawyer.
