The Council calls upon Serbia to implement recommendations presented by the ICTY Office of the Prosecutor to the United Nations Security Council in June 2010 concerning Serbia’s support in ongoing trials and appeals and Serbia’s assistance in the key matter of the arrest of the two remaining fugitives, Ratko Mladic and Goran Hadzic, which would be the most convincing proof of Serbia's efforts and cooperation with the ICTY".

5. Welcomes the surrender to the judicial authorities of the remaining two fugitives sought by the ICTY, Ratko Mladić and Goran Hadžić, by means of which entirely satisfactory cooperation with the ICTY has been achieved; underlines that their capture was not only a requirement for the further progress of Serbia towards the EU but, above all, a step towards bringing justice to the victims of the conflicts of the 1990s in the former Yugoslavia and reconciliation in the region; calls for continuous full and committed cooperation with the Tribunal and for a thorough investigation into and prosecution of persons engaged in the support networks which allowed the fugitives to hide for such a long time, particularly in the military and civilian security services;

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;

It once again urged the authorities in Belgrade to ensure that all remaining fugitive ICTY indictees, notably Ratko Mladic, are brought to justice without further delay.

2. The Council recalled its conclusions of 27 February 2006 that full cooperation with the ICTY must be achieved to ensure that the SAA negotiations are not disrupted, and reiterated the urgent need for Serbia and Montenegro to take decisive action to ensure that all remaining fugitive ICTY indictees, notably Radovan Karadzic and Ratko Mladic, are brought to justice.

Le Conseil a rappelé ses conclusions du 27 février 2006, selon lesquelles la coopération avec le TPIY doit être pleine et entière si l'on veut que les négociations sur l'accord de stabilisation et d'association ne soient pas interrompues, et a répété qu'il était urgent que la Serbie-Monténégro prenne des mesures décisives pour que toutes les personnes inculpées par le TPIY encore en fuite, notamment Radovan Karadzic et Ratko Mladic, soient traduites en justice.

The EU called on all states to render all necessary assistance to the ICTY, particularly to bring Ratko Mladic, Radovan Karadzic and Ante Gotovina, and all other fugitive indictees to the ICTY without delay.
