According to Protocol No 4 on the Ignalina nuclear power plant in Lithuania (1) attached to the 2003 Act of Accession (‘Protocol No 4’), acknowledging in 2004 the readiness of the Union to provide adequate additional Union assistance to the efforts by Lithuania to decommission the Ignalina nuclear power plant and highlighting this expression of solidarity, Lithuania committed to the closure of unit 1 of the Ignalina nuclear power plant before 2005 and of unit 2 of that plant by 31 December 2009 at the latest, and to the subsequent decommissioning of those units.

Recognising that the premature shutdown and consequent decommissioning of the Ignalina nuclear power plant with two 1 500 MW RBMK type reactor units inherited from the Soviet Union is of an unprecedented nature and represents for Lithuania an exceptional financial burden not commensurate with the size and economic strength of the country, Protocol No 4 states that the Union assistance under the Ignalina programme will be seamlessly continued and extended beyond 2006, for the period of next financial perspectives.

This Regulation establishes a programme for the implementation of Union financial support for measures connected with the decommissioning of units 1 and 2 of the Ignalina nuclear power plant in Lithuania (the ‘Ignalina programme’).

Based on the results of that assessment, the amount of the appropriations allocated to the Ignalina programme, as well as the programming period and distribution of funds amongst the Ignalina programme and the Kozloduy and Bohunice programmes as established in Council Regulation (Euratom) No 1368/2013 (8), may be reviewed to take account of the progress made in the implementation of those programmes and to ensure that the programming and allocation of the resources are based on actual payment needs and absorption capacity.

1. The general objective of the Ignalina programme is to assist the Member State concerned in implementing the steady process towards the decommissioning end state of units 1 and 2 of the Ignalina nuclear power plant in accordance with its decommissioning plan, whilst maintaining the highest level of safety.

L'objectif général du programme Ignalina est d'aider l'État membre concerné à atteindre un état irréversible dans le processus de déclassement des unités 1 et 2 de la centrale nucléaire d'Ignalina, conformément à son plan de déclassement, tout en maintenant le niveau de sûreté le plus élevé possible.

9. Lithuania, which, pursuant to Article 1 of Protocol No 4 on the Ignalina nuclear power plant in Lithuania, annexed to the 2003 Act of Accession, has committed to the closure of unit 2 of the Ignalina Nuclear Power Plant by 31 December 2009, may, if the total verified emissions of Lithuania in the period from 2013 to 2015 within the Community scheme exceed the sum of the free allowances issued to installations in Lithuania for electricity production emissions in that period and three-eighths of the allowances to be auctioned by Lithuania for the period from 2013 to 2020, claim allowances from the new entrants reserve for auctioning in accordance with the regulation referred to in Article 10(4).
9. La Lituanie qui, conformément à l’article 1er du protocole no 4 relatif à la centrale nucléaire d’Ignalina (Lituanie) annexé à l’acte d’adhésion de 2003, s’est engagée à fermer l’unité no 2 de sa centrale nucléaire d’Ignalina le 31 décembre 2009 au plus tard, peut, si le total vérifié de ses émissions de la période 2013-2015 dans le cadre du système communautaire est supérieur à la somme des quotas gratuits délivrés aux installations de Lituanie pour les émissions liées à la production d’électricité au cours de cette période et aux trois huitièmes des allocations devant être mises aux enchères en Lituanie pour la période 2013-2020, demander la mise aux enchères de quotas de la réserve destinée aux nouveaux entrants, conformément au règlement visé à l’article 10, paragraphe 4.
