In order to ensure the reliability and the efficiency of the preferential import arrangement, the Commission shall be empowered to adopt delegated acts in accordance with Article 4 laying down rules making the participation in the preferential import arrangement established in Article 1 conditional upon the lodging of a security.
Afin de garantir la fiabilité et l'efficacité du régime préférentiel à l'importation, la Commission est habilitée à adopter des actes délégués en conformité avec l’article 4 établissant des règles subordonnant la participation au régime préférentiel à l’importation établi à l’article 1 à la constitution d’une garantie.

3. The Commission shall adopt an implementing act suspending the application of the preferential import arrangement provided for in paragraph 1 of this Article once it ascertains that, during the year in progress, imports qualifying under the said arrangement have reached the quantity indicated in paragraph 2 of this Article .

La Commission adopte un acte d'exécution suspendant l'application du régime préférentiel à l'importation prévu au paragraphe 1 du présent article dès qu'elle constate que, pendant l'année en cours, les importations ayant bénéficié dudit régime ont atteint le volume indiqué au paragraphe 2 du présent article .

(3) In order to ensure the reliability and the efficiency of the preferential import arrangement, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission to establish rules making the participation in the arrangement conditional upon the lodging of a security in line with Commission Regulation (EC) No 1964/2006 of 22 December 2006 laying down detailed rules for the opening and administration of an import quota for rice originating in Bangladesh, pursuant to Council Regulation (EEC) No 3491/90 1 .
(3) Afin de garantir la fiabilité et l'efficacité du régime préférentiel à l'importation, il convient de déléguer à la Commission le pouvoir d'adopter des actes au titre de l'article 290 du traité afin d'établir des règles subordonnant la participation au régime à la constitution d'une garantie, conformément au règlement (CE) nº 1964/2006 de la Commission du 22 décembre 2006 portant modalités d'ouverture et mode de gestion d'un contingent d'importation de riz originaires du Bangladesh, en application du règlement (CEE) nº 3491/901 du Conseil 1 .

By means of an implementing act adopted without the assistance of the Committee referred to in Article 323(1) of Regulation No XXXX/XXXX, the Commission shall suspend the application of the preferential import arrangement provided for in paragraph 1 of this Article once it ascertains that, during the year in progress, imports qualifying under the said arrangement have reached the quantity indicated in paragraph 2.

Everything that contributes to better protection must, therefore, be welcomed and, once again, very important arrangements are being proposed to us, which I support: a national monitoring centre for security at sea and increased staff training, not forgetting the adequate equipping of ports – so many measures for which we have called many times in this House. That is what I think is important, even if I agree with my fellow MEPs in asking for these arrangements to be applied in a balanced and harmonious way, without compromising the actual activity of the ports.
Dès lors, tout ce qui va dans le sens d’une meilleure protection doit être accueilli favorablement et, une fois encore, des dispositions très importantes nous sont proposées, que je soutiens. 1. Without prejudice to any other provision on this subject, where the classification indicated in the documentation necessary for importation of the products covered by this Regulation differs from the classification determined by the competent authorities of the Member State into which they are to be imported, the goods in question shall be provisionally subject to the import arrangements which, in accordance with the provisions of this Regulation, are applicable to them on the basis of the classification determined by the aforementioned authorities.

Whereas this method takes account of the traditional import trade flows formed under the previous system; whereas, however, the introduction of a Community system must ensure progressive access by non-traditional importers; whereas the portion set aside for other applicants must make due allowance for the disparities in the above import arrangements in accordance with Article 6 (4) of Regulation (EC) No 520/94; whereas in the light of all these factors a balance must therefore be sought in determining the portion to be allocated to the two categories of importers;

(c) importation of goods declared to be under temporary importation arrangements, which thereby qualify for exemption from customs duties, or which would so qualify if they were imported from a third country;
