This paper looks at the arguments for and against extending geographical indication protection (already granted at EU level to agricultural products having specific characteristics linked to their place of origin) to non-agricultural products.

A number of indicators have already been agreed among Member States in the areas of social protection and social inclusion (see annex 2), and they are sufficiently robust as a basis for the introduction of quantitative targets.

The scope of the protection granted under this Regulation should be clarified, in particular with regard to those limitations on registration of new trade marks set out in Directive 2008/95/EC of the European Parliament and of the Council of 22 October 2008 to approximate the laws of the Member States relating to trade marks that conflict with the registration of protected designations of origin and protected geographical indications as is already the case for the registration of new trade marks at Union level.

It has to contain information as to the identity and nationality of the protected person; the use of any technological instruments provided to the protected person; particulars of the competent authority of the issuing State; the identification of the protection measure on the basis of which the EPO is adopted; a summary of the facts and circumstances which led to the imposition of the protection measure; the obligations or prohibitions imposed by the protection measure, their length and the express indication that their infringement constitutes a criminal offence under the law of the issuing State or may otherwise be punishable by a deprivation of liberty; the identification of the person causing a danger; any other circumstances that could have an influence on the assessment of the danger, and, where appropriate, the express indication that a judgment, as defined by Article 2 of Council Framework Decision 2008/947/JHA, or a decision on supervision measures, as defined by Article 4 of Council Framework Decision 2009/829/JHA, has already been transferred to another Member State and the identification of the competent authority for the enforcement of such a judgment or decision.

Work is already in progress in the indicators subgroup of the Social Protection Committee which has started to discuss this matter in order to elaborate a list of commonly agreed indicators that could underpin the EU-level co-operation process on safe and sustainable pensions.
