In accordance with its transparency policies and general Union principles on access to documents and information, the EIB shall make publicly available on its website information relating to all EIB financing and investment operations covered by this Regulation, including on the role of financial intermediaries, and relating to the manner in which those operations contribute to the general objectives set out in Article 9(2).

3. Financing agreements signed in relation to financing and investment operations covered by this Regulation shall include clauses allowing exclusion from EIB financing and investment operations and, if necessary, appropriate recovery measures in cases of fraud, corruption or other illegal activity in accordance with the EFSI Agreement, EIB policies and applicable regulatory requirements.
3. Les conventions de financement conclues pour les opérations de financement et d’investissement visées par le présent règlement comportent des clauses permettant d’exclure un bénéficiaire des opérations d’investissement et de financement de la BEI et prévoient, s’il y a lieu, des mesures de recouvrement appropriées en cas de fraude, de corruption ou d’autres activités illégales, conformément à l’accord EFSI, aux politiques de la BEI et aux exigences réglementaires applicables.

38. Expresses its concern about the fact that several EIB-financed projects have been affected by corruption and fraud; considers that the EIB document, dated 8 November 2013, which defines the EIB policy on preventing and deterring corrupt practices, fraud, collusion, coercion, obstruction, money laundering and terrorism financing, denotes a lack of sufficient control in a number of cases during the implementation of EIB-financed projects; expresses its concern at the fact that in 2013 the EIB financed the Passante of Mestre project for a total of EUR 350 million and that, despite the fact that this project has been affected by corruption and fraud, which led to the arrest of several of the people involved, it is considering whether to refinance the project for an additional amount of EUR 700 million through project bonds; asks, therefore, that, in cases of proven fraud and corruption, the EIB be required to suspend and/or block any foreseen and ongoing financing for the affected project;

The EIB shall provide the Commission with statistical, financial and accounting data on each EIB financing operation, as well as any additional information necessary to fulfil the Commission's reporting duties or requests by the Court of Auditors and an auditor's certificate on the outstanding amounts of the EIB financing operations.

4. For the purposes of the Commission's accounting and reporting of the risks covered by the EU guarantee, the EIB shall provide the Commission with the EIB's risk assessment and grading information concerning EIB financing operations.

For EIB financing operations, except those consisting of debt capital market instruments, entered into with a State, or guaranteed by a State, and for other EIB financing operations entered into with regional or local authorities, or public enterprises or institutions owned or controlled by a State, where such other EIB financing operations have an appropriate EIB credit risk assessment taking into account the credit risk situation of the country concerned, the EU guarantee shall cover all payments due to the EIB, but not received by it (‘Comprehensive Guarantee’).

Pour les opérations de financement de la BEI conclues avec un État ou garanties par un État, à l'exception de celles faisant appel à des instruments de financement sur le marché des capitaux d'emprunt, ainsi que pour les autres opérations de financement de la BEI conclues avec des autorités régionales ou locales ou avec des entreprises publiques ou des institutions appartenant à un État ou contrôlées par un État, lorsque ces autres opérations de financement de la BEI comportent une évaluation appropriée du risque de crédit encouru par la BEI compte tenu de la situation du pays concerné en matière de risque de crédit, la garantie de l'Union couvre tous les paiements qui sont dus à la BEI, mais qu'elle ne reçoit pas (ci-après dénommée «garantie globale»).
