In support of its appeals, Freixenet puts forward three pleas in law, alleging, first, infringement of Articles 38(3) and 73 of Regulation No 40/94, and Article 296 TFEU and Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, signed in Rome on 4 November 1950, second, infringement of Article 7(1)(b) of Regulation No 40/94 and, third, infringement of Article 7(3) of that regulation.

However, the Court has held that, in the light of other fundamental freedoms, such as the free movement of goods and the freedom to provide services, such prior authorisation, if not justified, could be regarded as an infringement of these fundamental freedoms.

I believe that this draft goes way too far in infringing privacy, for it is based in practice on the concept of surveillance even when no crime is suspected and is actually based on a kind of underlying suspicion of everyone. By its third ground of appeal, the appellant claims that the Court of First Instance infringed its right to be heard under the combined provisions of Article 6(2) EU, Article 6 of the European Convention on the Protection of Human Rights and Fundamental Freedoms and the first indent of Article 41(2) of the Charter of fundamental rights of the European Union proclaimed in Nice on 7 December 2000 (OJ 2000 C 364, p. 1).
