Due to increasing cross-border activity, competent authorities should provide each other with the relevant information for the exercise of their functions, so as to ensure the effective enforcement of this Directive including in situations where infringements or suspected infringements may be of concern to authorities in two or more Member States. In the exchange of information, strict professional secrecy is needed to ensure the smooth transmission of that information and the protection of particular rights.
Dans un contexte d'activité transfrontalière croissante, les autorités compétentes doivent se fournir mutuellement les informations nécessaires à l'exercice de leurs fonctions, de manière à garantir l'application effective de la présente directive, notamment lorsqu'une infraction ou une suspicion d'infraction peut intéresser les autorités compétentes de plusieurs États membres. Dans cet échange d'informations, le secret professionnel s'impose toutefois, pour assurer la transmission sans heurts desdites informations ainsi que la protection des droits des personnes concernées.
