3. The provisional determination of the applicable legislation, as provided for in paragraph 2, shall become definitive within two months of the institutions designated by the competent authorities of the Member States concerned being informed of it, in accordance with paragraph 2, unless the legislation has already been definitively determined on the basis of paragraph 4, or at least one of the institutions concerned informs the institution designated by the competent authority of the Member State of residence by the end of this two-month period that it cannot yet accept the determination or that it takes a different view on this.
3. 6. If the person concerned fails to provide the information referred to in paragraph 1, this Article shall be applied at the initiative of the institution designated by the competent authority of the Member State of residence as soon as it is appraised of that person’s situation, possibly via another institution concerned.

4. Where more than one competent authority intends to appoint a temporary administrator or apply any of the measures in Article 27 to more than one institution in the same group, the consolidating supervisor and the other relevant competent authorities shall consider whether it is more appropriate to appoint the same temporary administrator for all the entities concerned or to coordinate the application of any measures in Article 27 to more than one institution in order to facilitate solutions restoring the financial position of the institution concerned.
4. Lorsque plusieurs autorités compétentes envisagent, pour plusieurs établissements au sein du même groupe, de nommer un administrateur temporaire ou d’appliquer une des mesures visées à l’article 27, l’autorité de surveillance sur base consolidée et les autres autorités compétentes pertinentes vérifient s’il n’est pas plus approprié de nommer le même administrateur temporaire pour toutes les entités concernées, ou de coordonner l’application à plusieurs établissements de toute mesure prévue à l’article 27, afin de faciliter la mise en œuvre de solutions permettant de rétablir la position financière de l’établissement concerné.

National competent authorities shall communicate to the ECB before the date of application of this Regulation or, where relevant, before the dates referred to in paragraphs 2 and 3 of this Article, the identity of those credit institutions together with a report indicating the supervisory history and the risk profile of the institutions concerned, and any further information requested by the ECB.
