To that end, it shall investigate serious matters relating to the discharge of professional duties constituting a dereliction of the obligations of officials and other servants of the Union liable to result in disciplinary or, as the case may be, criminal proceedings, or an equivalent failure to discharge obligations on the part of members of institutions and bodies, heads of offices and agencies or staff members of institutions, bodies, offices or agencies not subject to the Staff Regulations (hereinafter collectively referred to as ‘officials, other servants, members of institutions or bodies, heads of offices or agencies, or staff members’).

The Office’s mandate should comprise the conduct of investigations within the institutions, bodies, offices and agencies established by, or on the basis of, the Treaties (‘institutions, bodies, offices and agencies’) and the exercise of the power of investigation conferred on the Commission by the relevant Union acts, as well as providing the Member States with assistance from the Commission in organising close and regular cooperation between their competent authorities.

The Office should be placed under precise obligations to inform the institutions, bodies, offices and agencies of investigations in progress where an official, other servant, member of an institution or body, head of office or agency, or staff member is concerned by the matter under investigation or where precautionary measures may be required in order to protect the financial interests of the Union.

4. Within the institutions, bodies, offices and agencies established by, or on the basis of, the Treaties (‘institutions, bodies, offices and agencies’), the Office shall conduct administrative investigations for the purpose of fighting fraud, corruption and any other illegal activity affecting the financial interests of the Union.

Au sein des institutions, organes et organismes institués par les traités ou sur la base de ceux-ci (ci-après dénommés «institutions, organes et organismes»), l’Office effectue les enquêtes administratives destinées à lutter contre la fraude, la corruption et toute autre activité illégale portant atteinte aux intérêts financiers de l’Union.

(vi) Assisting the Member States and the Union's institutions, bodies, offices and agencies in their efforts to collect, analyse and, in line with Member States' security requirements, disseminate relevant network and information security data; and on the basis of information provided by the Member States and the Union's institutions, bodies, offices and agencies in accordance with Union provisions and national provisions in compliance with Union law, maintaining awareness of the latest state of network and information security in the Union for the benefit of the Member States and the Union's institutions, bodies, offices and agencies;

(13) The Agency should assist the Member States as well as Union institutions, bodies, offices and agencies in their efforts to build and enhance cross-border capability and preparedness to prevent, detect and respond to network and information security problems and incidents; in this regard, the Agency should facilitate cooperation among the Member States and between the Member States, the Commission and Union institutions, bodies, offices and agencies.
(13) L'Agence devrait assister les États membres ainsi que les institutions, organes et organismes de l'Union dans leurs efforts pour mettre en place et développer des moyens transnationaux de préparation afin de prévenir les problèmes et incidents de sécurité des réseaux et de l'information, de les détecter et d'y faire face. If, on completion of an investigation, no evidence has been found against a member, manager, official or other servant or person serving an institution, body, office or agency or against an economic operator, the investigation into that person shall be closed and no further action taken, by decision of the Director General of the Office, who shall, within ten working days of the decision being taken, inform the person concerned and, where appropriate, the institution, body, office or agency in writing.

(3) While drawing attention to the responsibility of every department of the Commission and of the other institutions, bodies, offices and agencies of the European Union and European Communities (hereinafter "institutions, bodies, offices and agencies") to protect the Community's financial interests, and recognising the importance of prevention aspects when defining European policy in this field, including the fight against fraud and corruption, there is a need to widen the task of the Office to include those aspects.
(3) Tout en rappelant la responsabilité de chaque service de la Commission et des autres institutions, organes et organismes de l'Union européenne et des Communautés européennes (ci-après dénommés "institutions, organes et organismes") dans la protection des intérêts financiers communautaires et en reconnaissant l'importance des aspects de prévention dans la définition d'une politique européenne dans ce domaine, y compris la lutte contre la fraude et la corruption, il convient d'élargir la mission de l'Office à ces aspects.

4. Points out, however, that OLAF's remit, within the Community institutions, bodies, offices and agencies, includes administrative investigations to investigate 'serious matters relating to the discharge of professional duties such as to constitute a dereliction of the obligations of officials and other servants of the Communities liable to result in disciplinary or, as the case may be, criminal proceedings, or an equivalent failure to discharge obligations on the part of members of institutions and bodies, heads of offices and agencies or members of the staff of institutions, bodies, offices or agencies not subject to the staff regulations of officials or the conditions of employment of other servants of the Communities and on-the-spot checks and inspections in the Member States, though the information gathered by OLAF must be forwarded to the national judicial authorities when they relate to matters liable to result in criminal proceedings";
4. rappelle toutefois que le champ d'action de l'OLAF, au sein des institutions, organes et organismes communautaires, s'étend aux enquêtes administratives, "à rechercher les faits graves liés à l'exercice d'activités professionnelles, pouvant constituer un manquement aux obligations des fonctionnaires et agents des Communautés susceptible de poursuites disciplinaires et, le cas échéant, pénales ou un manquement aux obligations analogues des membres des institutions et organes, des dirigeants des organismes ou des membres du personnel des institutions, organes et organismes non soumis au statut des fonctionnaires des Communautés européennes ou au régime applicable aux autres agents de ces Communautés” et aux contrôles et vérifications sur place dans les États membres même si les informations rassemblées par l'OLAF doivent être transmises aux autorités judiciaires nationales lorsqu'elles portent sur des faits susceptibles de poursuites pénales;
