1. In cases where an interbranch organisation operating in a specific region or regions of a Member State is considered to be representative of the production of or trade in or processing of a given product, the Member State concerned may, at the request of that interbranch organisation, make binding some of the agreements, decisions or concerted practices agreed on within that organisation for a limited period on other operators operating in the region or regions in question, whether individuals or groups, who do not belong to the organisation.
1. Dans le cas où une organisation interprofessionnelle opérant dans une ou plusieurs régions déterminées d’un État membre est considérée, pour un produit donné, comme représentative de la production ou du commerce ou de la transformation de ce produit, l’État membre concerné peut, à la demande de cette organisation interprofessionnelle, rendre obligatoires, pour une période de temps limitée et pour d’autres opérateurs, individuels ou non, opérant dans la ou les régions en question et non membres de cette organisation, certains accords, certaines décisions ou certaines pratiques concertées arrêtés dans le cadre de cette organisation.

In cases where rules for one or more products are extended and where one or more of the activities referred to in Article 125l(3)(a) are pursued by a recognised interbranch organisation and are in the general economic interest of those persons whose activities relate to one or more of the products concerned, the Member State which has granted recognition may decide that individuals or groups which are not members of the interbranch organisation but which benefit from those activities shall pay the organisation all or part of the financial contributions paid by its members to the extent that such contributions are intended to cover costs directly incurred as a result of pursuing the activities in question’.

That Commission Decision shall not apply earlier than the date of its notification to the interbranch organisation concerned, unless that interbranch organisation has given incorrect information or abused the exemption provided for in paragraph 1.

(17) interbranch organisations set up on the initiative of individuals or existing groups of operators may, where they account for a significant proportion of the members of the various occupational divisions of the fishery product sector, help to take closer account of market realities and facilitate a commercial approach that will improve the reporting as well as the organisation of production, product presentation and marketing; since the work of such organisations may contribute in general to attaining the goals of Article 33 of the Treaty and in particular those of this Regulation, it is appropriate, once the relevant forms of action are defined, that recognition be granted to those organisations which carry out practical steps to attain the above goals; provision should be made, subject to certain conditions, for extension of the rules adopted by interbranch organisations and for the costs resulting from such extension to be shared; this procedure is subject to checks by the Commission, which may, in certain circumstances, declare such extensions null and void;
(17) les organisations interprofessionnelles constituées à l'initiative d'opérateurs individuels, ou déjà regroupées, et lorsqu'elles représentent une parie significative des différentes catégories professionnelles du secteur des produits de la pêche, sont susceptibles de contribuer à une meilleure prise en compte des réalités du marché, de faciliter l'évolution des comportements économiques en vue d'améliorer la connaissance, comme l'organisation de la production, la présentation et la commercialisation des produits; dès lors que les actions de ces organisations interprofessionnelles peuvent participer en général à la réalisation des objectifs fixés par l'article 33 du traité, et en particulier de ceux du présent règlement, il convient, après avoir défini les types d'actions concernés, d'accorder aux États membres la faculté de reconnaissance de celles de ces organisations qui mènent des actions positives au regard des objectifs précités; il convient, dans certaines conditions, de prévoir des dispositions en ce qui concerne l'extension des règles adoptées par les organisations interprofessionnelles et le partage des frais consécutifs à cette extension; cette procédure est soumise au contrôle de la Commission qui peut, dans certaines circonstances, prononcer la nullité des extensions en cause;
