Where recasting is not appropriate, the Commission will submit a proposal in accordance with the Interinstitutional Agreement of 20 December 1994 –Accelerated working method for official codification of legislative texts as soon as possible after the adoption of an amending act.

In particular, Article 218(6) TFEU provides that, except where an international agreement relates exclusively to the common foreign and security policy, the Council is to adopt the decision concluding the agreement in question after obtaining the consent of or consulting the European Parliament; all such international agreements which do not relate exclusively to the common foreign and security policy are therefore covered by this Interinstitutional Agreement.
En particulier, l’article 218, paragraphe 6, du traité sur le fonctionnement de l’Union européenne dispose que, sauf lorsqu’un accord international porte exclusivement sur la politique étrangère et de sécurité commune, le Conseil adopte la décision de conclusion de l’accord concerné après avoir obtenu l’approbation du Parlement européen ou l’avoir consulté. Tous les accords internationaux qui ne portent pas exclusivement sur la politique étrangère et de sécurité commune relèvent donc du présent accord interinstitutionnel.

The Declaration by the High Representative on political accountability (2), made upon the adoption of Council Decision 2010/427/EU of 26 July 2010 establishing the organisation and functioning of the European External Action Service (3), states that the High Representative will review and where necessary propose to adjust the existing provisions on access for Members of the European Parliament to classified documents and information in the field of security and defence policy (i.e. the Interinstitutional Agreement of 20 November 2002).

For the purposes of combating fraud, corruption and any other unlawful activity under Regulation (EU, Euratom) No 883/2013 of the European Parliament and of the Council (21), within six months from the day the Board becomes operational, it shall accede to the Interinstitutional Agreement of 25 May 1999 concerning internal investigations by OLAF and shall immediately adopt appropriate provisions applicable to all staff of the Board using the template set out in the Annex to that Interinstitutional Agreement.

To ensure homogeneous protection, Parliament, the Council and the Commission invited the other institutions and bodies to join the interinstitutional agreement and adopt the common system in accordance with the model Decision annexed to it.[15] Article 2(1) of the Commission Decision establishing the Office defines the material scope of internal investigations in a way corresponding to the interinstitutional agreement.
