In order to ensure uniform conditions for the implementation of this Regulation as regards exports and certain general provisions, implementing powers should also be conferred on the Commission in respect of measures on the treatment of refund certificates by the Member States and the exchange of information and the specific administrative assistance between the Member States as regards the refund certificates, measures on the fixing of the global amount allocated to small exporters and the individual threshold of exemption from the presentation of refund certificates, measures on the issuing of replacement refund certificates and duplicate refund certificates, measures limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of those certificates and suspending the lodging of applications for refund certificates where amounts that exceed available amounts fixed on the basis of the commitments resulting from international agreements, are applied for, necessary procedural rules and technical criteria for the application of other measures with regard of exports, measures on fixing the applicable duty in case of direct offsetting in preferential trade and the related amounts payable on exports to the country or region concerned, measures ensuring that processed agricultural products declared for export under a preferential trade agreement are not in fact exported under a non-preferential agreement or vice versa, measures concerning the methods of qualitative and quantitative analysis of processed agricultural products and non-Annex I goods, the technical provisions necessary for their identification and the procedures for the purpose of their classification in the Combined Nomenclature.

(b) where it is no longer compatible with the interpretation of one of the nomenclatures referred to in Article 20 (6) either at Community level by reason of amendments to the combined nomenclature or by a judgment of the Court of Justice of the European Communities, or, at international level by reason of a classification opinion or an amendment of the explanatory notes to the Nomenclature of the Harmonized Commodity Description and Coding System adopted by the Customs Cooperation Council; in that case the date on which binding tariff information ceases to be valid shall be the date of publication of the said measures or, in the case of international measures, the date of the Commission communication, in the 'C' of the Official Journal of the European Communities;

Due to the need to comply with international agreements, the Commission should be empowered to modify the technical procedures for the calculation methods concerning thresholds as well as to periodically revise the thresholds themselves; references to the CPV nomenclature may undergo regulatory changes at Union level and it is necessary to reflect those changes into the text of this Directive; the technical details and characteristics of the devices for electronic receipt should be kept up to date with technological developments; it is also necessary to empower the Commission to make mandatory certain technical standards for electronic communication to ensure the interoperability of technical formats, processes and messaging in procurement procedures conducted using electronic means of communication taking into account technological developments; the Commission should also be empowered to adapt the list of legislative acts of the Union establishing common methodologies for the calculation of life-cycle costs; the list of International Social and Environmental Conventions and the list of Union legislation whose implementation creates a presumption of free access to a given market as well as Annex II„ setting out a list of legal acts to be taken into account when assessing the existence of special or exclusive rights, should be quickly adapted to incorporate the measures adopted on a sectoral basis.
Eu égard à la nécessité de se conformer aux accords internationaux, la Commission devrait être habilitée à modifier les modalités techniques des méthodes de calcul des seuils et à réviser périodiquement les seuils eux-mêmes; les références à la nomenclature CPV étant susceptibles de faire l’objet de modifications réglementaires au niveau de l’Union, il est nécessaire d’intégrer ces modifications dans le texte de la présente directive; les détails et les caractéristiques techniques des dispositifs de réception électronique devraient être actualisés en fonction de l’évolution des technologies; il est également nécessaire d’habiliter la Commission à imposer des normes techniques de communication électronique, afin d’assurer l’interopérabilité des formats techniques, des procédures et des messageries dans le cadre des passations de marché par voie électronique, en tenant compte de l’évolution des technologies; pour intégrer les mesures adoptées au niveau sectoriel, il conviendrait d’habiliter également la Commission à adapter rapidement la liste des actes législatifs de l’Union établissant des méthodes communes de calcul des coûts du cycle de vie, la liste des conventions internationales en matière sociale et environnementale, la liste des actes juridiques de l’Union dont la mise en œuvre crée une présomption de libre accès à un marché, et l’annexe II qui énumère les actes à prendre en considération pour établir l’existence de droits spéciaux ou exclusifs; pour répondre à cette nécessité, la Commission devrait être habilitée à actualiser ces listes.
