It should also be clarified that the conditions relating to the enforcement of observance of applicable obligations in the fields of environmental, social and labour law, established by Union law, national law, collective agreements or by the international environmental, social and labour law provisions listed in this Directive, provided that such rules and their application comply with Union law, should be applied whenever the national law of a Member State provides for a mechanism of joint liability between subcontractors and the concessionaire.

‘verification’ means the conformity assessment process carried out by an environmental verifier to demonstrate whether an organisation's environmental review, environmental policy, environmental management system and internal environmental audit and its implementation fulfils the requirements of this Regulation.

The operational scheme of EMAS and the general requirements for participation remain essentially the same as under the current Regulation: organisations can participate in EMAS on condition that they develop an environmental policy, carry out an environmental review, establish an environmental management system, carry out an internal environmental audit and develop an environmental statement.
Le principe de fonctionnement de l'EMAS et les conditions générales de participation restent en substance identiques à celles du règlement en vigueur. Pour participer à l'EMAS, les organisations doivent définir une politique environnementale, effectuer une analyse environnementale, mettre en place un système de management environnemental, réaliser un audit environnemental interne et établir une déclaration environnementale.

Preference was given to international environmental liability for two reasons: either their scope is greater as they apply on a worldwide basis and legally bind more countries than only EU Member States (this is the case with conventions covering oil pollution), or their regime provides for additional guarantees, for example by operating with compensation funds.
