8. Is deeply concerned by the increase of gender-based violence (GBV) in emergency situations; calls on State and non-State parties to comply with their legal obligations under international humanitarian law and other applicable norms, and to take measures against GBV and Female Genital Mutilation and ensure the accountability of perpetrators; strongly condemns every act of GBV, especially by staff working under an international mandate; emphasises the internationally declared legal basis for the right to sexual and reproductive health and rights for victims of sexual violence and for people in conflicts;

13. Urges the Commission to acknowledge that international humanitarian law mandates that women and girl victims of war rape be provided with all the necessary medical care required by their condition, including abortions; in consequence, calls on the Commission to update its humanitarian aid policy to affirm that in situations of armed conflict the Geneva Conventions apply, and therefore require humanitarian actors to provide necessary medical care required by victims’ conditions and the full range of sexual and reproductive health services, including abortions; stresses that the denial of abortion to women and girls impregnated by war rape breaches the prohibition of torture and cruel treatment under the Geneva Conventions, common Article 3;

48. Calls on the EU Member States to ensure that coordination and cooperation with the ICC is included in the mandate of relevant regional EU Special Representatives (EUSRs); calls on the High Representative to appoint an EUSR on International Humanitarian Law and International Justice with the mandate to promote, mainstream and represent the EU's commitment to the fight against impunity and the ICC across EU foreign policies;
48. demande aux États membres de l'Union de s'assurer que la coordination et la coopération avec la CPI soient incluses dans le mandat des représentants spéciaux de l'Union européenne (RSUE) des régions concernées; appelle la haute représentante à nommer un RSUE pour le droit humanitaire international et pour la justice internationale dont le mandat consiste à promouvoir, intégrer pleinement et représenter l'attachement de l'Union à la lutte contre l'impunité et à la CPI dans toutes les politiques étrangères de l'Union;

Given the central role played by the main international organisations with a humanitarian mandate (United Nations agencies, International Committee of the Red Cross (ICRC), International Federation of Red Cross and Red Crescent Societies (IFRC), etc) in the effective delivery of humanitarian aid, DG ECHO continued in 2007 to support the reinforcement of their institutional capacities through thematic funding programmes.

EU donors' criteria for selection of implementing partners include professionalism and management capacity, capacity to respond to identified need (technical and logistical capacity, including presence and access), adherence to the humanitarian principles and international law, as well as international codes of conduct, guidelines and best practice in delivery of aid, specialist knowledge or mandate, cost-efficiency, local partnership and experience in operational contexts, readiness to take part in coordination activities established for overall operational effectiveness, accountability, including reporting transparently on results, and quality of implementation capacity, including sound financial management.

Similarly, the International Committee of the Red Cross has a specialised mandate based on international treaties and is in many contexts, particularly in conflict situations, one of the few — sometimes the only — partner with access in order to be able to provide protection and to deliver humanitarian assistance.

2.3. On co-ordination, the Commission, recognizing the potential problem that the multiplicity of humanitarian organisations involved in relief and rehabilitation efforts might cause for the effective delivery of aid, has adopted several measures to reinforce the role of the UN as the mandated body for the co-ordination of international humanitarian aid efforts.
2.3 S'agissant de la coordination, la Commission, qui reconnaît que le nombre élevé d'organisations humanitaires participant aux travaux de remise en état risque d'affecter la fourniture de l'aide, a pris plusieurs mesures visant à renforcer le rôle des Nations unies en tant qu'organisme mandaté pour coordonner l'aide humanitaire à l'échelon international.

The defining criteria for selection of implementing partners should be: professionalism; capacity to respond to identified need (including presence and access); adherence to the humanitarian principles, international guidelines and best practice in delivery of aid; specialist knowledge or mandate; cost-efficiency; local partnership and context; accountability, including reporting transparently on results.

Implementing partners also include international agencies and organisations entrusted by the international community with a humanitarian mandate such as the International Committee of the Red Cross, the International Federation of the Red Cross and Red Crescent Societies as well as programmes, funds and agencies which form part of the United Nations system such as the United Nations High Commissioner for Refugees (UNHCR), World Food Programme (WFP), World Health Organisation (WHO) and United Nations International Children’s Emergency Fund (UNICEF).
