The Council has noted the views of the European Parliament as expressed in recent resolutions, particularly on the recognition of agriculture as a strategic sector in the context of food security, on the EU protein deficit and on the link between EU agriculture and international trade.

2. Recalls the severe consequences of past BSE diseases, which led to a threat to public health and wide-scale export bans on the EU's internal market, hampered Member States' external trade activities and caused serious damage to the EU's livestock sector; takes the view that processed animal proteins are a valuable source of proteins and part of the solution for rebalancing the EU’s protein deficit; takes note of the Commission communication to Parliament and the Council entitled ‘The TSE Roadmap 2’ (COM(2010)0384), which seeks to ease the ban on the use of processed animal proteins from non-ruminants in non-ruminant feed; stresses that easing the feed ban can be considered only if scientific evidence and testing methods guarantee that the transmission of diseases can be excluded and the prohibition on intra-species recycling can be enforced;
2. rappelle les graves conséquences d'épidémies passées comme celle de l'encéphalopathie spongiforme bovine, qui a représenté une menace pour la santé publique, entraîné des interdictions à grande échelle d'exportations vers le marché intérieur de l'Union, entravé les activités de commerce extérieur de certains États membres et provoqué de graves dommages au secteur européen de l'élevage; est néanmoins d'avis que la transformation de protéines animales représente une source précieuse de protéines et contribue au rééquilibrage du déficit européen en protéines; prend acte de la communication de la Commission au Conseil et au Parlement européen, intitulée "Feuille de route n° 2 pour les encéphalopathies spongiformes transmissibles (EST)" (COM(2010)0384), qui vise à assouplir l'interdiction d'utiliser des protéines animales transformées quand il s'agit d'introduire des protéines issues de non-ruminants dans l'alimentation de non-ruminants; souligne que l'assouplissement de cette interdiction ne peut être envisagée que si des preuves scientifiques et des techniques d'analyses garantissent l'exclusion de tout risque de transmission de maladies et l'interdiction du recyclage par la même espèce;

The conditions under which hydrolysed proteins may be considered safe according to that opinion are laid down in Regulation (EC) No 1774/2002 of the European Parliament and of the Council of 3 October 2002 laying down health rules concerning animal by-products not intended for human consumption (4).

The Council adopted a legislative package for the reform of the market in milk products, concerning respectively the introduction of flat-rate aid for the school milk scheme, whatever the fat content of the milk (EUR 16,11/100 kg), the alignment of the protein content of European milk with the international standard set at 34% (standardisation) and indication of the exact fat content, the latter measure being intended to improve consumer information (12750/07, 13004/07, 13006/07 and 12790 ADD1).

In particular, I have asked for an analysis of Council Directive 71/18/EEC: the belief is that piece of legislation bans the inclusion of water and hydrolysed protein for the purpose of retaining the water.
