Since the objectives of this Directive, namely to foster the development of the Union railways, to set out broad principles for granting licences to railway undertakings and to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof, cannot be sufficiently achieved by the Member States on account of the manifestly international dimension of issuing such licences and operating significant elements of the railway networks, and of the need to ensure fair and non-discriminatory terms for access to the infrastructure, and can therefore, by reason of their trans-national implications, be better achieved at Union level, the Union may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.

3. Recognises that the fight against international terrorism cannot, however, be pursued by military means alone, and that the prevention and repression of terrorism require a whole range of non-military measures such as intelligence-sharing and police and judicial cooperation, for which full interinstitutional and inter-pillar cooperation is needed, and that the building of democratic institutions, infrastructure and civil society in failed or failing states is required; stresses that one of the greatest contributions of the European Union to preventing international terrorism is its capacity to be effective in the building or rebuilding of democratic institutions, social and economic infrastructure, good governance and civil society and in successfully combating racism and xenophobia;

(22) Since the objective of this Directive, namely to harmonise the conditions applicable to tolls and user charges for the use of road infrastructure, cannot be satisfactorily achieved by the Member States acting alone and can therefore, by reason of its European dimension and with a view to safeguarding the internal market for transport, be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity enshrined in Article 5 of the Treaty.
(22) Étant donné que l'objectif de la présente directive, à savoir l'harmonisation des conditions applicables aux péages liés à l'utilisation des infrastructures routières, ne peut pas être réalisé de manière suffisante par les États membres et peut donc, en raison de sa dimension communautaire et eu égard à la sauvegarde du marché intérieur des transports, être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité.

Since the objective of this Directive, namely the development of the Community’s railways, cannot be sufficiently achieved by the Member States, given the need to ensure fair and non-discriminatory conditions of access to infrastructure and to take account of the obviously international dimension of the way in which important parts of the rail networks operate, as well as the need for coordinated transnational action, and can therefore be better achieved at Community level, the Community may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
Étant donné que l’objectif de la présente directive, à savoir le développement des chemins de fer communautaires, ne peut pas être réalisé de manière suffisante par les États membres eu égard à la nécessité d’assurer des conditions d’accès à l’infrastructure équitables et non discriminatoires et de tenir compte de la dimension manifestement internationale de segments importants des réseaux ferroviaires et peut donc, en raison de la nécessité d’une action transnationale coordonnée, être mieux réalisé au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l’article 5 du traité.

(18 ) Given that the objectives of the proposed action, namely to harmonise the conditions applicable to tolls and user charges for the use of road infrastructure, cannot be satisfactorily achieved by the Member States and may therefore be better achieved at Community level by reason of their European dimension and with a view to safeguarding the internal transport market, the Community can take measures, in accordance with the principle of subsidiarity enshrined in Article 5 of the Treaty.
(18) Étant donné que les objectifs de l'action envisagée, à savoir l'harmonisation des conditions applicables aux péages liés à l'utilisation des infrastructures routières, ne peuvent pas être réalisés de manière suffisante par les États membres et peuvent donc, en raison de leur dimension communautaire et eu égard à la sauvegarde du marché intérieur des transports, être mieux réalisés au niveau communautaire, la Communauté peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité.

(49) In accordance with the principles of subsidiarity and proportionality as set out in Article 5 of the Treaty, the objectives of this Directive, namely to coordinate arrangements in the Member States governing the allocation of railway infrastructure capacity and the charges made for the use thereof as well as safety certification, cannot be sufficiently achieved by the Member States in view of the need to ensure fair and non-discriminatory terms for access to the infrastructure as well as to take account of the manifestly international dimensions involved in the operation of significant elements of the railway networks, and can therefore, by reason of the need for coordinated trans-national action, be better achieved by the Community.
(49) Conformément au principe de subsidiarité et au principe de proportionnalité tels qu'énoncés à l'article 5 du traité, les objectifs de la présente directive, à savoir la coordination des systèmes des États membres régissant la répartition des capacités d'infrastructure ferroviaire et la perception de redevances d'utilisation de ladite infrastructure ainsi que la délivrance des certificats de sécurité, ne peuvent pas être réalisés de manière suffisante par les États membres, compte tenu de la nécessité d'assurer des conditions équitables et non discriminatoires pour l'accès à l'infrastructure et de tenir compte de la dimension manifestement internationale du fonctionnement d'éléments importants des réseaux ferroviaires, et peuvent donc être mieux réalisés au niveau communautaire en raison de la nécessité d'une action transnationale coordonnée.
