Against the background of a very good and comprehensive report, the UN Special Rapporteur on Burma has now called for an international investigation commission to be established which will have the mandate to investigate war crimes and crimes against humanity.
Sur la base d’un rapport absolument remarquable et très exhaustif, le rapporteur spécial des Nations unies sur les droits de l’homme en Birmanie a recommandé récemment la création d’une commission d’enquête internationale qui aurait pour mission d’enquêter sur les crimes de guerre et les crimes contre l’humanité commis en Birmanie.

The model decision attached to the Interinstitutional Agreement of 25 May 1999 between the European Parliament, the Council and the Commission, and, as regards Commission officials, Decision 1999/396, both of which concern the terms and conditions for internal investigations in relation to the prevention of fraud, corruption and any illegal activity detrimental to the Communities’ interests, merely require, in the second paragraph of Article 4, that the Secretary-General of the institution must agree that the obligation to invite the person concerned to give his views may be deferred where the needs of the investigation require.
La décision modèle annexée à l’accord interinstitutionnel du 25 mai 1999 entre le Parlement européen, le Conseil et la Commission et, pour ce qui concerne les fonctionnaires de la Commission, la décision 1999/396, toutes deux relatives aux conditions et modalités des enquêtes internes en matière de lutte contre la fraude, la corruption et toute activité illégale préjudiciable aux intérêts des Communautés, exigent seulement, dans leur article 4, paragraphe 2, que le secrétaire général de l’institution donne son accord à ce que l’obligation d’entendre l’intéressé soit différée lorsque les besoins de l’enquête l’exigent.

Notes with concern that between 2006 and 2008 only 37 out of 222 internal investigations gave rise to disciplinary proceedings and that, of these 37 investigations, only two produced genuine consequences, three were halted for lack of evidence and the other 32 – i.e. 87% – have yet to produce results; calls on the Commission to undertake to pursue internal investigations just as vigorously as external investigations and to ensure that those investigations which have not yet given rise to effective disciplinary follow-up produce results;

Wishes to be informed about external investigations in the same way it is informed about internal investigations; insists that the Commission and/or the Member State concerned inform OLAF about the judicial and/or disciplinary follow-up measures initiated by the Commission and/or Member State once they have received the investigation file;

Welcomes the Commission's support for the idea of a European Public Prosecutor and expects the Commission in the Green Paper it has announced also to examine how, in accordance with paragraph 8 of its Resolution of 14 March 2001 on the 1999 report on the fight against fraud, a European Public Prosecutor's Office for financial matters can be set up on the basis of the EU Treaty whose jurisdiction would be limited initially to internal investigations and which would have a purely advisory and supporting role vis-à-vis the national judicial authorities without any authority to issue instructions; points out that the call to set up such an office, whose remit would initially be confined to internal investigations, is endorsed by the OLAF Supervisory Committee in its latest progress report and cited as one of the preconditions for ensuring the legality and legitimacy of OLAF's investigations;
