5. By way of derogation from paragraphs 1 to 4 of this Article, Member States may decide that international protection shall lapse by law where the beneficiary of international protection has unequivocally renounced his or her recognition as such. Where the expulsion of a beneficiary of international protection outside the territory of the Union is permitted under Directive 2004/83/EC, Member States should be obliged to ensure that all information is obtained from relevant sources, including, where appropriate, from the Member State that granted international protection, and that it is thoroughly assessed with a view to guaranteeing that the decision to expel that beneficiary is in accordance with Article 4 and Article 19(2) of the Charter of Fundamental Rights of the European Union.

(25) The procedure for the suspension of transfers should also be applied when the Commission considers that the level of protection for applicants for international protection in a given Member State is not in conformity with Community legislation on asylum, in particular in terms of reception conditions, qualification for international protection and access to the asylum procedure, with a view to ensuring that all applicants for international protection benefit from an adequate level of protection in all Member States.

(b) Considers that the extension of the scope of Directive 2003/109/EC to both refugees and beneficiaries of subsidiary protection is important with regard to the respect of the equal treatment of people benefiting from international protection; underlines that excluding persons benefiting from subsidiary protection from the scope of the proposal will result in a more complicated legal framework that will markedly reduce the benefits expected from the proposed Directive.

L. whereas, although the 1951 Convention and its Protocol of 1967 are the cornerstone of the system of international protection for refugees, the Convention by itself is not enough, and hence the Agenda for Protection aims to ensure progress on the basis of the Convention, by adapting and reinforcing the system of international protection, guaranteeing greater solidarity and supplementing the management of asylum flows with more modern instruments or policies in response to the challenges currently encountered in any attempt to address the refugee problem satisfactorily on a worldwide basis, in the face of the problems involved in applying international protection provisions in situations where there are mixed migration flows and millions of people are obliged to live in exile in order to seek protection from persecution and danger,

The June 2003 Communication underpinned this new approach with three specific but complementary policy objectives: 1) the orderly and managed arrival of persons in need of international protection in the EU from the region of origin; 2) burden- and responsibility sharing within the EU as well as with regions of origin enabling them to provide effective protection as soon as possible and as closely as possible to the needs of persons in need of international protection, and 3) the development of an integrated approach to efficient and enforceable asylum decision-making and return procedures.
4.
