2. For the purpose of taking a decision on the admissibility of an application for international protection pursuant to Article 33(2)(d), a subsequent application for international protection shall be subject first to a preliminary examination as to whether new elements or findings have arisen or have been presented by the applicant which relate to the examination of whether the applicant qualifies as a beneficiary of international protection by virtue of Directive 2011/95/EU.
2. Given that third-country nationals and stateless persons who have expressed their wish to apply for international protection are applicants for international protection, they should comply with the obligations, and benefit from the rights, under this Directive and Directive 2013/33/EU of the European Parliament and of the Council of 26 June 2013 laying down standards for the reception of applicants for international protection .

4. Member States shall ensure that the appropriate bodies referred to in Article 10 of Directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008 on common standards and procedures in Member States for returning illegally staying third-country nationals have the right to lodge an application for international protection on behalf of an unaccompanied minor if, on the basis of an individual assessment of his or her personal situation, those bodies are of the opinion that the minor may have protection needs pursuant to Directive 2011/95/EU.

Member States shall provide, under the same eligibility conditions as nationals of the Member State that has granted protection, adequate health care, including treatment of mental disorders when needed, to beneficiaries of international protection who have special needs, such as pregnant women, disabled people, persons who have undergone torture, rape or other serious forms of psychological, physical or sexual violence or minors who have been victims of any form of abuse, neglect, exploitation, torture, cruel, inhuman and degrading treatment or who have suffered from armed conflict.

38. Expresses its deep concern at the serious situation which will inevitably arise in future if, on the one hand, Member States have to apply Council Directive 2004/83/EC of 29 April 2004 on minimum standards for the qualification and status of third country nationals or stateless persons as refugees or as persons who otherwise need international protection and the content of the protection granted , the scope of which covers the two types of international protection (refugees and subsidiary protection), whilst, on the other hand, the scope of the future directive on minimum standards on procedures in Member States for granting and withdrawing refugee status is confined to the examination of applications for international protection based on the reasons listed in the Geneva Convention of 1951 and the Protocol of 1967, since applications for subsidiary protection are outside its scope;

I therefore wish to highlight an extremely positive aspect of the Commission proposal, which is the complementarity of the dual status of international protection in which, in addition to the narrow approaches of the 1950s, the concept is extended to subsidiary protection, clarifying the concept of the perpetrators of persecution not limited solely to the State and its agents but also to material circumstances and others in which the outcome is that the State does not give protection, either because it cannot or because it does not want to, and we can all recall such situations in Africa and in Latin America. We also have the concept’s inclusion of the protection organisations of stable quasi-State authorities, which must be held responsible in practical terms for the protection of individuals who fall outside the scope of simple peace or military security missions, which often relegate into second place the effective protection of individuals and respect for human rights. Lastly, extending refugees’ rights in terms of periods of residence, employment and integration mechanisms, which concern every aspect of refugees’ citizenship.
C’est pourquoi il est très positif que la proposition de la Commission prévoie la complémentarité du double statut de protection internationale qui, au-delà des conceptions étroites des années 50, étend le concept à la protection subsidiaire ; la clarification du concept d’agent de persécution non lié étroitement à l’État et à ses agents, mais aussi aux circonstances matérielles et autres qui font que l’État n’offre pas de protection soit parce qu’il ne peut pas soit parce qu’il ne veut pas (nous nous souvenons tous de l’Afrique et de l’Amérique latine) ; l’inclusion dans le concept d’institutions de protection des autorités permanentes s'apparentant à un État (il s’agit de les investir de responsabilités concrètes dans la protection des individus qui dépassent les routines de la simple mission de paix et de la sécurité militaire, qui renvoient souvent au second plan la protection effective des individus et le respect des droits de l’homme) ; et, finalement, l'extension des droits des réfugiés quant aux délais de séjour, à l’emploi et aux mécanismes d’intégration, qui concernent tous les aspects de la citoyenneté du réfugié.

Employment restrictions upon status determination seriously hinder refugee integration in the long term as they risk pushing people into illegal work or encouraging dependency on public assistance. The restrictions in relation to access to vocational training have the negative effect of delaying considerably the process of acquisition of the skills and knowledge by persons in need of international protection that are necessary to access the labour market and live independently.
Le fait de restreindre l'accès à la formation professionnelle a pour effet négatif de retarder sensiblement chez les personnes qui ont besoin d'une protection internationale le processus d'acquisition des techniques et connaissances qui leur sont nécessaires pour entrer sur le marché du travail et mener une vie indépendante.

(c) "displaced persons" means third-country nationals or stateless persons who have had to leave their country or region of origin, or have been evacuated, in particular in response to an appeal by international organisations, and are unable to return in safe and durable conditions because of the situation prevailing in that country, who may fall within the scope of Article 1A of the Geneva Convention or other international or national instruments giving international protection, in particular:
