IN-CONTEXT TRANSLATIONS

The internal road market framework is well established. While national road haulage is largely protected, international road transport is liberalised. Cabotage, the carriage of goods within one country by a haulier from another country, accounts for 1.2% of national road transport markets. By 2009 at the latest cabotage will be opened in respect of all new Member States. Common rules on the level of professional qualifications and working conditions contribute to high safety and social standards.
Le cadre du marché intérieur du transport routier est bien établi. Alors que le transport routier national est largement protégé, cette activité a été libéralisée à l’international. Le cabotage, c’est-à-dire le transport de marchandises à l’intérieur d’un pays par un transporteur d’un autre pays, représente 1,2 % de l’activité des marchés nationaux du transport routier; d’ici à 2009 au plus tard, le cabotage sera ouvert à l’égard de tous les nouveaux États membres. Des règles communes relatives au niveau des qualifications professionnelles et aux conditions de travail contribuent à assurer un niveau élevé de sécurité et de protection sociale.

To ensure fair competition in the internal road transport market and to send a clear signal to drivers and transport undertakings, Member States should impose, in compliance with the categories of infringements defined in Directive 2006/22/EC, effective, proportionate, dissuasive and non-discriminatory penalties, without prejudice to the principle of subsidiarity.
Pour garantir une concurrence loyale sur le marché intérieur des transports par route et pour transmettre un signal clair aux conducteurs et aux entreprises de transport, les États membres devraient imposer, conformément aux catégories d’infractions définies dans la directive 2006/22/CE, des sanctions effectives, proportionnées, dissuasives et non discriminatoires, sans préjudice du principe de subsidiarité.

The European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport of 1 July 1970 (the AETR), as amended, should continue to apply to the carriage by road of goods and passengers by vehicles registered in any Member State or any country which is a contracting party to the AETR, for the whole of the journey where that journey is between the Community and a third country other than Switzerland and the countries which are contracting parties to the Agreement on the European Economic Area or through such a country.
L'accord européen relatif au travail des équipages des véhicules effectuant des transports internationaux par route du 1er juillet 1970 (ci-après «l'AETR»), tel que modifié, devrait continuer de s'appliquer aux transports par route de marchandises ou de voyageurs effectués par des véhicules immatriculés dans un État membre ou dans un pays qui est partie contractante à l'AETR, pour l'ensemble du trajet, à savoir tant la partie située entre la Communauté et un pays tiers, autre que la Suisse et les pays parties contractantes à l'accord sur l'Espace économique européen, que la partie traversant le territoire d'un tel pays.

Difficulties have been experienced in interpreting, applying, enforcing and monitoring certain provisions of Regulation (EEC) No 3820/85 relating to driving time, break and rest period rules for drivers engaged in national and international road transport within the Community in a uniform manner in all Member States, because of the broad terms in which they are drafted.
Des difficultés ont été rencontrées en ce qui concerne l'uniformité de l'interprétation, de l'application, de l'exécution et du contrôle, dans tous les États membres, de certaines dispositions du règlement (CEE) no 3820/85 relatives aux durées de conduite, aux pauses et aux temps de repos à observer par les conducteurs effectuant des transports routiers nationaux et internationaux à l'intérieur de la Communauté, en raison du caractère général des termes dans lesquels ces règles sont rédigées.

(6) The scope of this Directive covers only mobile workers employed by transport undertakings established in a Member State participating in mobile road transport activities covered by Regulation (EEC) No 3820/85 or, failing that, by the European agreement concerning the work of crews of vehicles engaged in international road transport (AETR).

Whereas a system should be defined to apply to international road transport operations to or from a third country or between two countries in transit through the territory of a Member State; whereas the provisions of the European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport (AETR) of 1 July 1970 should apply to those transport operations; whereas in the case of vehicles registered in a State which is not a Contracting Party to AETR, those provisions will only apply to that part of the journey effected within the Community;

2. The European Agreement concerning the Work of Crews of Vehicles engaged in International Road Transport (AETR) shall apply instead of the present rules to international road transport operations:

" HOWEVER , WITH EFFECT FROM THE ENTRY INTO FORCE OF THE EUROPEAN AGREEMENT CONCERNING THE WORK OF CREWS OF VEHICLES ENGAGED IN INTERNATIONAL ROAD TRANSPORT ( AETR ) , ANY INTERNATIONAL ROAD TRANSPORT OPERATION FROM OR TO A THIRD COUNTRY PARTY TO THAT AGREEMENT SHALL , IF CARRIED OUT BY MEANS OF VEHICLES REGISTERED IN ANY SUCH THIRD COUNTRY , BE GOVERNED BY THE PROVISIONS OF THE AFORESAID AGREEMENT ".
