Calls, therefore, for the EU to mainstream human rights in all aspects of its relations with Iran; believes that a high-level and inclusive human rights dialogue with Iran should be part of the future policy framework for bilateral EU–Iran relations; calls for the EU to start a human rights dialogue with Iran that includes the judiciary and security forces and establishes clearly defined benchmarks against which progress can be measured; calls for the EU to support fully the work of the UN Special Rapporteur on the situation of human rights in the Islamic Republic of Iran, and calls on Iran to grant him an immediate and unconditional entry visa; encourages UN High Commissioner Navi Pillay to take up the Iranian authorities’ invitation to visit Iran; calls on Iran to declare a moratorium on the death penalty;

Expresses grave concern regarding the human rights situation in Iran, the continued repression of reformists, the growing number of political prisoners and prisoners of conscience and faith, the discrimination against and persecution of the Baha‘i community, the consistently high number of executions, including of minors, the widespread torture, the unfair trials and exorbitant sums demanded for bail, and the heavy restrictions on the freedom of information, expression, assembly, religion, education and movement; welcomes the release of several prisoners of conscience in Iran, including lawyer and Sakharov Prize winner Nasrin Sotoudeh; calls on the Iranian authorities to release the three opposition leaders held under house arrest with no charges for over two years, Mehdi Karroubi, Zahra Rahnavard and Mir Hossein Mousavi, allow the UN Special Rapporteur on human rights in Iran to visit the country, work towards a moratorium on the death penalty, remove internet censorship and allow freedom of expression in Iran; notes the resumption of diplomatic contacts between Iran and the international community and hopes for a satisfactory and mutually acceptable conclusion to negotiations between the E3+3 and Iran on Iran‘s nuclear programme;

By its appeal, the French Republic seeks to have set aside the judgment of the Court of First Instance of the European Communities of 4 December 2008 in Case T‑284/08 People’s Mojahedin Organisation of Iran v Council [2008] ECR I‑3487 (‘the judgment under appeal’), by which that court upheld the action brought by the People’s Mojahedin Organization of Iran (‘the PMOI’) for annulment of Council Decision 2008/583/EC of 15 July 2008 implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/868/EC (OJ 2008 L 188, p. 21, ‘the contested decision’), insofar as it concerned the PMOI.
Par son pourvoi, la République française demande l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 4 décembre 2008, People’s Mojahedin Organization of Iran/Conseil (T‑284/08, Rec. p. II‑3487, ci-après l’«arrêt attaqué»), par lequel celui-ci a accueilli le recours de la People’s Mojahedin Organization of Iran (ci-après la «PMOI») tendant à l’annulation de la décision 2008/583/CE du Conseil, du 15 juillet 2008, mettant en œuvre l’article 2, paragraphe 3, du règlement (CE) nº 2580/2001 concernant l’adoption de mesures restrictives spécifiques à l’encontre de certaines personnes et entités dans le cadre de la lutte contre le terrorisme, et abrogeant la décision 2007/868/CE (JO L 188, p. 21, ci-après la «décision litigieuse»), pour autant qu’elle concerne la PMOI.

Is appalled to learn that, according to annual reports on the death penalty in Iran, the number of executions in 2009 was the highest for the past 10 years, making Iran the country with the highest number of executions per capita in the world; calls upon Iran to issue official statistics concerning the application of the death penalty; calls on Iran to abolish definitively the death penalty for crimes committed before the age of 18 and to amend its legislation, which violates the international human rights conventions that Iran has ratified, including the Convention on the Rights of the Child and the ICCPR; calls on the Iranian authorities, in accordance with UN General Assembly Resolutions 62/149 and 63/138, to institute a moratorium on executions pending the abolition of the death penalty; underlines the fact that the EU institutions need to exert constant pressure on Iran in this respect;
12. est consterné d'apprendre que, selon des rapports annuels sur la peine de mort en Iran, le nombre d'exécutions en 2009 était le plus élevé des dix dernières années, faisant de l'Iran le pays comptant le plus d'exécutions par habitant à l'échelle mondiale; demande à l'Iran de publier des statistiques officielles sur l'application de la peine de mort; demande à l'Iran qu'il abolisse définitivement la peine de mort pour les crimes commis avant l'âge de 18 ans et qu'il modifie sa législation qui viole les conventions internationales sur les droits de l'homme qu'il a ratifiées, y compris la convention relative aux droits de l'enfant et le PIDCP; demande aux autorités iraniennes, conformément aux résolutions 62/149 et 63/138 de l'Assemblée générale des Nations unies, d'instaurer un moratoire sur les exécutions dans l'attente de l'abolition de la peine de mort; souligne la nécessité pour les institutions de l'Union européenne d'exercer une pression constante sur l'Iran à cet égard;

14. The EU is Iran's principal trading partner, with roughly 40% of EU imports coming from Iran and roughly 36% of Iran's exports going to the EU.
