In accordance with Article 6a of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, as annexed to the TEU and to the TFEU, the United Kingdom and Ireland are not bound by the rules laid down in this Directive which relate to the processing of personal data by the Member States when carrying out activities which fall within the scope of Chapter 4 or Chapter 5 of Title V of Part Three of the TFEU where the United Kingdom and Ireland are not bound by the rules governing the forms of judicial cooperation in criminal matters or police cooperation which require compliance with the provisions laid down on the basis of Article 16 TFEU.

As a result also of this Commission decision, Vice-President Marin sent a letter on 26 April 1989 to ten Member States (all of them with the exception of the United Kingdom and Ireland, in respect of which infringement procedures under Article 169 of the Treaty had been initiated), in which, in order to completely clarify the situation, he requested them to send the Commission as quickly as possible the laws and regulations applicable to their own nationals and to those of other Member States as regards the conditions governing access to fishing activities and the allocations of licences or other authorizations used for the management of the quotas allocated to each country.

CONSIDERING that in accordance with Protocol No 21 on the position of the United Kingdom of Great Britain and Northern Ireland and of Ireland in respect of the area of Freedom, Security and Justice annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, Ireland will not take part in this Agreement unless it notify its wish to that effect in accordance with that Protocol,
