It should however be noted that the act of which Mr Borghezio is accused relates to the offence of criminal damage, which according to Section 639, in the variant of paragraph 2, of the Italian Criminal Code, is an offence for which prosecution is mandatory and for which a term of imprisonment of up to one year or a fine is prescribed.
