‘2a. Member States shall recognise the qualifications of specialised doctors awarded in Italy, and listed in points 5.1.2 and 5.1.3 of Annex V, to doctors who started their specialist training after 31 December 1983 and before 1 January 1991, despite the training concerned not satisfying all the training requirements set out in Article 25, if the qualification is accompanied by a certificate issued by the competent Italian authorities stating that the doctor concerned has effectively and lawfully been engaged, in Italy, in the activities of a medical specialist in the same specialist area concerned, for at least seven consecutive years during the 10 years preceding the award of the certificate’.

Les États membres reconnaissent les titres de formation de médecin spécialiste délivrés en Italie et énumérés à l’annexe V, points 5.1.2 et 5.1.3, aux médecins qui ont débuté leur formation spécialisée après le 31 décembre 1983 et avant le 1er janvier 1991, bien que la formation concernée ne réponde pas à tous les critères de formation énoncés à l’article 25, si la qualification est accompagnée d’un certificat délivré par les autorités italiennes compétentes attestant que le médecin concerné a exercé effectivement et légalement, en Italie, la profession de médecin spécialiste dans la spécialité concernée, pendant au moins sept années consécutives au cours des dix années précédant la délivrance du certificat».

2a. Having received other similar complaints from Italian doctors concerning this matter, the Commission services examined Italian case law and found that the principles laid down by the Court of Justice of the EC in its rulings in cases C-131/97 Carbonari and C-371/97 Gozza had been fully respected by the national court.
