[26] If we look at the origin of infringement proceedings (see 19th report annex, Tables 3 and 4), except in 2001, the proportion of proceedings initiated on the basis of a complaint is lower than that of proceedings initiated on the basis of investigations by Commission departments (cases detected on the Commission's own initiative). If we add cases of non-notification, complaints account for a minority of proceedings initiated. At the reasoned opinion stage, the proportion of proceedings initiated on the basis of complaints is lower, in all years, than the proportion initiated on the basis of the Commission's own investigations, excluding non-notification cases.

(20) The Commission should be able, on its own initiative or at the application of interested parties or a Member State, to initiate at any time an external investigation into restrictive procurement and concessions practices allegedly maintained by a third country. In its decision to initiate an external investigation procedure, it should take into account the number of requests made by contracting authorities/entities or Member States.

The quality of the own-initiative reports that are tabled and then adopted here is open to question but, if you stop allowing amendments, how can own-initiative reports be improved?

– (DE) Madam President, ladies and gentlemen, Mr President of the Commission, having the President of the Commission present for a debate on an own-initiative report is not an everyday occurrence, for an own-initiative report is not exactly an outstanding event when what we are actually meant to be doing is making laws – although I shall turn to that in a moment. What your presence here demonstrates is that the Commission is clear in its own mind about how important this issue is in the eyes of the public, and hence, too, in those of the citizens’ representatives here in this House.
- (DE) Madame la Présidente, Mesdames et Messieurs, Monsieur Barroso, ce n’est pas tous les jours que le président de la Commission fait le déplacement pour assister à un débat sur un rapport d’initiative, ce type de document n’étant pas vraiment quelque chose d’extraordinaire en soi, alors que ce que nous sommes censés faire, c’est légiférer. Mais j’y reviendrai dans un instant. En revanche, votre présence aujourd’hui démontre que la Commission a pleinement conscience du caractère essentiel que revêt cette question aux yeux du grand public et, partant, aux yeux des représentants des citoyens qui composent cette Assemblée.

In addition to its own internal evaluation, the Commission shall, at its own initiative or at the request of the European Parliament or the Council, contract, by means of public tender, independent external evaluations to evaluate its multiannual indicative programmes and to assess the quality of its geographical and thematic programmes, and to make recommendations for the attainment of their objectives.
