The Secretary-General is authorised to delegate, in whole or in part, to the Director-General of Administration any or all of his powers as regards the application of the Conditions of Employment and the application of the Staff Regulations to officials in the AST and AST/SC function groups, except for powers in respect of the appointment and termination of service of officials and the engagement of other servants.

Where the Secretary-General is prevented from exercising his functions, or where the post is vacant, they shall be exercised by the Deputy Secretary-General present with the highest grade or, in the event of equal grade, by the Deputy Secretary-General with the greatest seniority in the grade or, in the event of equal seniority, by the eldest or by an official designated by the Commission.

124. As regards the applicant’s complaint that his views were heard after the Secretary-General had consulted the Quaestors, with the result that the latter were not able to take account of his comments, it must be recalled that, as consultation with the Quaestors does not bind the Secretary-General as regards his decision on the inference to be drawn from the absence of supporting documents, the fact that the applicant’s views were heard after the said consultation was not such as to infringe the rights of the defence.
124 En ce qui concerne le reproche du requérant selon lequel il a été entendu après la consultation par le secrétaire général des questeurs, de sorte que ces derniers n’ont pas pu tenir compte de ses remarques, il y a lieu de rappeler que, la consultation des questeurs ne liant pas le secrétaire général quant à sa décision sur les conséquences à tirer de l’absence de pièces justificatives, le fait que le requérant ait été entendu après ladite consultation n’a pas été de nature à violer les droits de la défense.

67. With regard to the breach of Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, the applicant observes that, as a result of his letter of 21 April 2003 (see paragraph 43 above), in which he had pointed out that the Rules Governing the Payment of Expenses and Allowances had been incorrectly applied in his regard, and given that no agreement had been reached between the Secretary-General and himself, the matter should have been referred to the Quaestors in accordance with that article for them to take a decision after consulting the Secretary-General and, where appropriate, the President or the Bureau.
67 S’agissant de la violation de l’article 27, paragraphe 2, de la réglementation FID, le requérant fait observer que, à la suite de sa lettre du 21 avril 2003 (voir point 43 ci-dessus), dans laquelle il avait relevé que la réglementation FID avait été incorrectement appliquée à son égard, et compte tenu du fait qu’aucun accord n’était intervenu entre le secrétaire général et lui-même, cette question aurait dû être renvoyée aux questeurs conformément à cet article afin que ces derniers prennent une décision après consultation du secrétaire général et, éventuellement, du président ou du bureau.

In this regard the applicant recalls his letter of 6 February 2003 to the Secretary-General (see paragraph 39 above), which contained a new breakdown showing that the justified expenses under the heading of the secretarial allowance now amounted to EUR 191 860, that is to say EUR 138 741 justified by the documents attached to the said letter in addition to the EUR 53 119 already justified by the audit, so that the balance to be repaid to the Parliament amounted to EUR 50 722.
Le requérant rappelle à cet égard sa lettre du 6 février 2003 adressée au secrétaire général (voir point 39 ci-dessus), qui comportait un nouveau décompte, selon lequel les dépenses au titre de l’indemnité de secrétariat justifiées s’élevaient désormais à 191 860 euros, à savoir 138 741 euros justifiés par les éléments annexés à ladite lettre s’ajoutant aux 53 119 euros déjà justifiés par l’audit, de sorte que le solde à rembourser au Parlement s’élevait à 50 722 euros.

29. By letter of 12 April 2002 the Secretary-General of the Parliament (‘the Secretary-General’) reminded the applicant of the various allowances that had been paid to him since the beginning of his term of office and asked him to provide, by the end of April 2002, facts and figures on the use of the credits paid as secretarial allowances between 1999 and 31 January 2001 and details on the use of credits paid as general expenditure allowances.
29 Par lettre du 12 avril 2002, le secrétaire général du Parlement (ci-après le « secrétaire général ») a rappelé au requérant les différentes indemnités qui lui ont été versées depuis le début de son mandat et lui a demandé de fournir, avant la fin du mois d’avril 2002, des indications chiffrées relatives à l’utilisation des crédits versés au titre de l’indemnité de secrétariat depuis 1999 jusqu’au 31 janvier 2001, ainsi que des précisions sur l’utilisation des crédits versés au titre de l’indemnité pour frais généraux.
