The hon. member is caught by the facts of this case. Any fair reading of the Krever report makes it clear that it was January 1986 on that the federal regulator should have insisted that the test be put in place.

Articles 48 and 208 of the Act of Accession require both the new Member States and the Member States of the Community of Ten to adjust progressively, as from 1 January 1986, any national monopolies of a commercial character within the meaning of Article 37(1) of the EEC Treaty, so as to ensure that by the end of the transitional period (end of 1991 in the case of Spain and end of 1992 in the case of Portugal), products from the two new Member States may be freely imported and distributed without discrimination in relation to national products.
