22 (1) Where a person who has been carrying on a business has, in a taxation year, sold all or substantially all the property used in carrying on the business, including the debts that have been or will be included in computing the person’s income for that year or a previous year and that are still outstanding, and including the debts arising from loans made in the ordinary course of the person’s business if part of the person’s ordinary business was the lending of money and that are still outstanding, to a purchaser who proposes to continue the business which the vendor has been carrying on, if the vendor and the purchaser have executed jointly an election in prescribed form to have this section apply, the following rules are applicable:

(c) the aggregate value of outstanding loans made by the association and its subsidiaries, whether individually or jointly, to entities engaging in an activity described in subsection (1) that the association holds control of, or a substantial investment in, under paragraph 390(2)(f) of the Act.

60. Reiterates with concern that a considerable number of outstanding issues remain unresolved in this area, notably the lack of transparency (especially concerning information about the final beneficiaries), the difficulty in assessing the economic and social impact of the loans (resulting in a flawed targeted approach) and the reliance, via outsourcing of responsibilities, on financial intermediaries for carrying out the due diligence; urges the Bank to provide details on its approach to accelerate measures addressing these issues and asks for a stringent list of criteria for selection of these financial intermediaries to be established by the EIB jointly with the Commission and be made publicly available;
60. rappelle avec inquiétude qu'un nombre notable de questions restent en suspens dans ce domaine, notamment en ce qui concerne l'absence de transparence (surtout pour ce qui est des informations relatives aux bénéficiaires finaux), la difficulté d'évaluer l'impact économique et social des prêts (ce qui se traduit par une approche biaisée) et la dépendance, due à l'externalisation des responsabilités, à l'égard des intermédiaires financiers pour la réalisation de la diligence raisonnable; demande instamment à la Banque de fournir des détails sur l'approche adoptée pour accélérer les mesures visant à résoudre ces problèmes et demande qu'une liste rigoureuse de critères de sélection des intermédiaires financiers soit établie par la BEI en collaboration avec la Commission et soit publiée;
