Definition: These are severe disturbances in the personality and behavioural tendencies of the individual; not directly resulting from disease, damage, or other insult to the brain, or from another psychiatric disorder; usually involving several areas of the personality; nearly always associated with considerable personal distress and social disruption; and usually manifest since childhood or adolescence and continuing throughout adulthood.

– (FR) Mr President, Ministers, Commissioner, ladies and gentlemen, I will not repeat all of the key points made by my fellow Members in relation to justice and immigration, but I did wish to point out that a European judicial area can only be established by enhancing mutual confidence among Member States, since that will improve the principle of mutual recognition, the cornerstone of the Europe of justice.
- Monsieur le Président, Madame et Monsieur le Ministre, Monsieur le Commissaire, chers collègues, je ne répéterai pas les éléments essentiels qu’ont exprimés mes collègues en matière de justice et d’immigration, mais je tenais à rappeler qu’un espace judiciaire européen ne pourra être mis en place que par le renforcement d’une confiance mutuelle entre États membres, qui viendra ainsi améliorer le principe de reconnaissance mutuelle, pierre angulaire de l’Europe de la justice.

Since December 2009, as a result of the entry into force of the Lisbon Treaty and the legally binding nature of the Charter of Fundamental Rights, the provisions in the Lisbon Treaty governing legislative instruments in the area of police and judicial cooperation have changed the context in which the EAW operates.

Since the Amsterdam Treaty entered into force, the European area of justice has become a reality. It is founded on a number of legislative instruments designed to guarantee the mutual recognition of judicial decisions, create a culture of cooperation between national legal authorities and accompany the free movement of citizens in a European area without internal frontiers.

I listened carefully to the recommendations of several Members, in particular Mr Collins, who called for determined and vigorous measures; I also noted the encouragement offered by Mr Berthu, calling on us to continue to work towards an objective that has clearly emerged since Amsterdam and since Tampere: a common judicial area, with the necessary cooperation between Member States and between all the services – and let me say to Mr Dupuis that I certainly mean all the services – and the necessary harmonisation or communitarisation in some areas.
J'ai été attentif aux recommandations de détermination et de rigueur de plusieurs d'entre vous, notamment de M. Collins, sensible aux encouragements de M. Few measures have been adopted in the area of judicial cooperation in civil matters, an area in which the EU can act since the Maastricht Treaty. To date, the most important measure is the Convention on the service of documents in civil or commercial matters in the Member States of the European Union.
Les principaux instruments facilitant la coopération judiciaire civile ont été élaborés au niveau international (conventions de Bruxelles et de Rome par exemple). Le traité de Maastricht marque une première étape importante en la matière, introduisant une base juridique à la coopération judiciaire civile entre les États membres et permettant l'adoption de plusieurs conventions.

Since the question of asylum, immigration and judicial cooperation in civil matters now pertains to the first pillar, the Community has new areas of external competence which give it influence at international level in these fields.
En effet, l'asile, l'immigration et la coopération judiciaire en matière civile relevant désormais du premier pilier, la Communauté possède de nouvelles compétences externes qui lui permettront d'exercer une influence sur le plan international dans ces domaines.
