III. I.3. Considers that the principle laid down in Article K.4 of the Treaty on European Union (future Article 32 of the Treaty on European Union) with regard to mutual judicial assistance whereby the Council is to determine 'the conditions and limitations under which' judges and investigating and prosecuting officials may operate in the territory of another Member State in liaison and in agreement with the authorities of that State could be applied more in the civil field, where the degree of integration should reflect the fact that this legislation is now of a Community nature;
III. I.3. considère que le principe prévu par l"article K.4 TUE (futur article 32 TUE) en matière d'entraide judiciaire selon lequel le Conseil fixe "les conditions et les limites dans lesquelles" juges et magistrats peuvent intervenir sur le territoire d'un autre Etat membre en liaison et en accord avec les autorités de celui-ci pourrait davantage être appliqué dans le domaine civil, où le niveau d"intégration devrait correspondre à la nature désormais communautaire de cette législation;
