The Commission's Rule of Law Recommendation sent today to Poland covers four new legislative acts now adopted by thePolish Parliament which in the Commission's assessment will increase the systemic threat to the rule of law: the Law on the Supreme Court, the Law on the National Council for the Judiciary (both 'vetoed' on 24 July by the President of the Republic), the Law on the Ordinary Courts Organisation (signed by the President of the Republic on 25 July and awaiting publication and entry into force); and the Law on the National School of Judiciary (published and in force since 13 July).
La recommandation concernant l'état de droit que la Commission a adressée aujourd'hui à la Pologne concerne quatre actes législatifs désormais adoptés par le parlement polonais qui, selon l'appréciation de la Commission, accroîtront la menace systémique pesant sur l'état de droit. Polish courts like the courts of all Member States are called upon to provide an effective remedy in case of violations of EU law, in which case they act as the "judges of the Union" and must comply with the requirements of the independence of the judiciary in line with the Treaty and the Charter of Fundamental Rights.

The competence of the supervisory authorities should not cover the processing of personal data when courts are acting in their judicial capacity, in order to safeguard the independence of the judiciary in the performance of its judicial tasks, including decision-making.

33. Welcomes the amendments to Act CLXI of 2011 on the organisation and administration of courts of Hungary and Act CLXII of 2011 on the legal status and remuneration of judges of Hungary, adopted by the Hungarian Parliament on 2 July 2012, which address many of the concerns expressed in the European Parliament’s resolution of 16 February 2012 and by the Venice Commission in its opinion;
33. est satisfait des modifications apportées à la loi CLXI de 2011 sur l'organisation et l'administration des tribunaux hongrois et à la loi CLXII de 2011 sur le statut juridique et la rémunération des juges hongrois, adoptées par le parlement hongrois le 2 juillet 2012, qui répondent à bon nombre des préoccupations exprimées par le Parlement européen dans sa résolution du 16 février 2012 et par la commission de Venise dans son avis;

The Judiciary Act was amended to change the rules on the appointment of judges with the aim of further strengthening the independence of the judiciary.
