Points out that 2011 was the second full year in which the new Statute for Members and the Statute for Assistants has been in force (both effective as of 14 July 2009); notes that the Implementing Measures for the Statute for Assistants have been amended four times in those two years for the application of Title VII of the Conditions of Employment of Other Servants of the European Union (CEOS) and the Implementing Measures on the basis of proposals from the Temporary Evaluation Group and the Secretary-General; recalls that the implementation of Title VII of the CEOS created a single scheme governing the status of accredited parliamentary assistants (APAs) working in Parliament's three working places, which replaced twenty-seven different national systems of contractual relationships, taxation and social security and that currently there is no evidence that would suggest a need to adapt the rules applying to parliamentary assistants contained in Title VII of the CEOS; suggests a full evaluation of the Statute of Assistants including possible adaptations of the rules before the next European elections;

The Tribunal finds, lastly, that, even though the applicant does not put forward any argument or plea in support of the requests forming the subject-matter of the first part of the note of 28 July 2009, the fact remains that it may be inferred from the actual wording of the note of 28 July 2009 that the applicant was complaining that she had not received the documents she had asked for several times, inter alia in her e-mail of 14 May 2009, concerning written test (b), and in her e-mail of 4 July 2009 and her request for review of 10 July 2009, concerning written test (c).

In the present case, since the decision not to admit the applicant to the oral test constitutes a decision of a competition selection board which, as such, is open to challenge before the Tribunal without a prior administrative complaint, the three-month time-limit for bringing an action laid down in Article 91(3) of the Staff Regulations, extended on account of distance by a single period of 10 days in accordance with Article 100(3) of the Rules of Procedure, began to run from the notification, on an unspecified date, of that decision by letter of 23 July 2009 and by 28 July 2009 at the latest, the date of the note entitled ‘Complaint’ in which the applicant acknowledged that she was aware of that decision, and expired on 7 November 2009.
En l’espèce, la décision de non-admission à l’épreuve orale constituant une décision de jury de concours susceptible, en tant que telle, d’être attaquée devant le Tribunal sans réclamation administrative préalable, le délai de recours de trois mois établi à l’article 91, paragraphe 3, du statut, majoré du délai de distance forfaitaire de dix jours en vertu de l’article 100, paragraphe 3, du règlement de procédure, a commencé à courir à partir de la notification, à une date indéterminée, de cette décision par lettre du 23 juillet 2009 mais, au plus tard le 28 juillet 2009, date de la note intitulée «R[éclamation]» dans laquelle la requérante reconnaît en avoir pris connaissance, et a expiré le 7 novembre 2009.

In a note dated 28 July 2009, entitled ‘Complaint’, the applicant made reference to Article 90(2) of the Staff Regulations, acknowledged receipt of the letter of 23 July 2009 and stated that she had asked, without success, for a copy of her written tests (b) and (c) and of the personal evaluation sheets showing how the selection board had marked those tests; she then reiterated those requests, adding that she wished to receive any additional information concerning her in connection with her participation in the competition.

Secondly, it is clear from the wording of her note that its purpose was to challenge the selection board’s decision that had been notified to her by letter of 23 July 2009 which was attached to the note.

Secondly, the Commission contends that the note of 28 July 2009, which the applicant entitled ‘Complaint’ within the meaning of Article 90(2) of the Staff Regulations, was no more than a request for documents, and did not have the minimum content required for a ‘prior administrative complaint’ within the meaning of the provisions of the Staff Regulations, which is why that note did not have the effect of suspending the time-limit of three months and ten days before the matter could be referred to the Tribunal.

Takes note of the Internal Memorandum on the Renault and Peugeot case chronology communicated by the Commission; regrets the period of 22 months of assessment between the submission of the application on 9 October 2009 and the presentation of the proposal for decision to the Budgetary Authority on 11 July 2011; notes that this is so far the longest period of assessment of an application for the mobilisation of the EGF since its creation in 2007 (case chronology annexed);

Notes the suspension by the Commission of payments in Romania under the SAPARD programme in July 2008 due to weaknesses and irregularities identified by its services, and welcomes the action plan presented by Romania addressing these deficiencies, which allowed the Commission to withdraw the suspension of payments in July 2009;
