I. whereas this practice is worth formalising so that it can serve as a precedent for the future, and whereas it should also be improved; whereas, on the European patent system, the European Council called into question a legislative agreement concluded between Parliament and the Council; whereas, on economic governance, the European Council saw fit to renegotiate provisions identical to those which a previous regulation had already made applicable; whereas, on an EU banking supervisory authority, the European Council adopted two contradictory positions one year apart, which it could have avoided by taking greater account of Parliament’s position; whereas negotiations on the 2014-2020 multiannual financial framework saw the legislative process held to ransom as the legally required unanimity in the Council could only be achieved by pre-empting certain major policy choices in the regulations on the policies to be financed, which, in these areas, reduces Parliament’s role to one of merely amending secondary provisions;

Where an arrangement has been concluded between the competent authorities of France and a province providing a comprehensive pension plan, concerning that provincial comprehensive pension plan, Canada may, if it deems necessary, for the purposes of applying this Agreement, conclude an arrangement with that province in order to coordinate the Canada Pension Plan and that provincial plan and may, among other things, accept periods of contribution to the provincial plan as periods of contribution under the legislation of Canada.

2. Where an understanding has been concluded between the competent authority of Portugal and a province providing a comprehensive pension plan, concerning that provincial comprehensive pension plan, Canada may, if it deems necessary, for the purposes of applying this Agreement, conclude an understanding with that province in order to co-ordinate the Canada Pension Plan and that provincial plan and may, among other things, accept periods of contributions to the provincial plan as periods of contributions under the legislation of Canada.
2. Lorsqu’une entente a été conclue entre l’autorité compétente portugaise et une province ayant institué un régime général de pensions, relativement à ce régime provincial de pensions, le Canada pourra, s’il le juge nécessaire, aux fins d’application du présent Accord, conclure avec cette province une entente quant aux modalités de coordination du Régime de pensions du Canada et de ce régime et entre autres pour accepter comme période de cotisation à la législation du Canada les périodes de cotisation au régime provincial.

To date, the federal government has concluded tripartite agreements with regional First Nations’ organizations and provincial authorities in six provinces and one territory – Manitoba, New Brunswick, Ontario, Quebec, Alberta, Prince Edward Island and Yukon – and a sub-regional agreement with the Saskatoon Tribal Council.17 Unlike the agreements concluded in British Columbia and Nova Scotia, these agreements are not legally binding and do not involve a transfer of jurisdiction recognized by new federal and provincial legislation.

Calls on the Council and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the adoption of the requisite national implementing legislation, in conformity with Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the Action Plan; points out that not all Council presidencies pursue this common goal with the same vigour; asks all presidencies to mention the status of the ICC cooperation in all summits with third countries; requests that such efforts be extended to include ratification and implementation of the Agreement on the Privileges and Immunities of the ICC, which is an important operational tool for the ICC; notes the entry into force on 8 December 2007 of the agreement with the United Kingdom on the enforcement of sentences (and the entry into force of a similar agreement concluded with Austria in 2005), and urges all Member States to consider concluding similar agreements with the ICC; acknowledges the Cooperation and Assistance Agreement between the European Union and the ICC as an important tool to supplement the obligations incumbent on individual Member States;

We are for an open market and absolutely free trade, we abide by the terms of the North American Free Trade Agreement and the agreements concluded as a result of the Uruguay Round. In that sense, we are definitely not crazy about this kind of legislation, be it Canadian or American.
