This initiative, which is proposed by four Member States, provides for the creation of a judicial coordination unit (Eurojust) comprising one national member per Member State, who must be a prosecutor, magistrate or police officer.
La présente initiative, proposée par quatre pays membres, prévoit l'institution d'une unité de coordination judiciaire "Eurojust", composée d'un membre national par État membre ayant la qualité de procureur, de magistrat ou d'officier de police.

(4a) The judicial coordination unit Eurojust should when collecting, processing and using personal data comply with the principles of the Council of Europe Convention No 108 of 28 January 1981 and Recommendation R 87/15 of the Council of Europe Committee of Ministers of 17 September 1987, and should in all cases comply with the rules of the individual Member States.

Negotiations are still under way in the Council on the decision concerning the creation of Eurojust, but the Council has already set up, by decision of 14 December 2000, the provisional judicial cooperation unit (Pro-Eurojust), [40] which took up its duties on 1 March 2001. Its role is to help coordinate prosecutions and set up the future Eurojust unit proper.

The Treaty of Nice supplements Article 31 of the EU Treaty with a reference to and description of the tasks of "Eurojust" (European Judicial Cooperation Unit), whose task will be to facilitate proper coordination between national prosecuting authorities within the framework of judicial cooperation in criminal matters.
