Notes that when the Lisbon Treaty established the European Council as an institution its tasks were defined in Article 15 TEU as ‘to provide the Union with the necessary impetus for its development and to define the general political directions and priorities’, explicitly excluding the exercise of legislative functions; points out that the European Council has intervened in the legislative procedure by deciding to remove specific elements from texts already agreed by Parliament and the Council; recalls in this connection the de facto deletion of Articles 6 to 8 of the agreed text on the proposal for a regulation on a European patent with unitary effect and considers such interventions by the European Council to be illegitimate;

Agrees, as regards the Common AgricultuPersonNameral Policy, to the priorities comprising the consolidation and implementation of the initiatives started in 2008, in particular the single Common MarPersonNamekePersonNamet OrganisaPersonNametions (CMO), the legislative proposals on the 'Health Check', the follow-up to the Green Paper on Quality and the expected effects of climate change on the agricultuPersonNameral sector; stresses that rising food prices, conservation and sustainable use of agricultuPersonNameral biodiversity, the school fruit scheme, the quality of agricultuPersonNameral products, less favoured areas, most deprived persons - food aid, the WTO, qualified marPersonNamekePersonNamet access and fair trade conditions - social and ecological tPersonNamerading standards - in free tPersonNameraPersonNamede arrangements are other areas that need particular attention in 2009;

Within the spirit of subsidiarity, the responsibility for implementing programmes supported by the Structural Funds lies primarily with the Member States while the Commission’s responsibility is to ensure that EU legislation and agreed policy priorities are observed (Detailed ex-post audits are carried out by the EU on a sample basis.) The Polish administration has added other procedural requirements in line with Polish legal practice.
D’après le principe de subsidiarité, la responsabilité de la mise en œuvre des programmes soutenus par les Fonds structurels incombe principalement aux États membres. La responsabilité de la Commission, quant à elle, est de veiller au respect de la législation et des priorités politiques communautaires (Des audits ex post détaillés sont réalisés par l’UE sur la base d’échantillons.) (6) To that end Community assistance will be focused mainly on building up an institutional, legislative, economic and social framework directed at the values and models subscribed to by the European Union and on promoting a market economy, with due regard for priorities agreed with the partners concerned.
