no payment may be made under this Act
to any depositor or liquidator in respect of the deposit or part thereof unless
the Minister, or an agent thereof appointed under subsection 12(1), is satisfied that the deposit or part thereof has been applied, to the extent of the lesser of the amount of the deposit or part thereof that is subject to the security interest and the amount of the set-off that could be ass
erted, to reduce or extinguish the obligation, and ...[+++] the amount of the deposit or part thereof has been reduced accordingly.
(2) Dans le cas où une demande de paiement est présentée au titre de la présente loi par un déposant relativement à tout ou partie d’un dépôt dans une institution financière et que l’un des points suivants est douteux ou contestable, le ministre, le déposant ou le liquidateur nommé relativement à l’institution financière peut demander à un tribunal compétent du Canada de trancher la question :
