124. When in the course of the winding-up of the business of a company under this Act it appears that any past or present director, manager, liquidator, receiver, employee or officer of the company has misapplied or retained in his own hands, or become liable or accountable for any moneys of the company, or been guilty of any misfeasance or breach of trust in relation to the company, the court may, on the application of any liquidator or of any creditor or contributory of the company, notwithstanding that the offence is one for which the offender is criminally liable, examine into the conduct of the director, manager, liquidator, receiver, employee or officer and, after that examination, may make an order requiring him to repay any moneys so misapplied or retained, or for which he has become liable or accountable, together with interest at such rate as the court thinks just, or to contribute such sums of money to the assets of the company, by way of compensation in respect of the misapplication, retention, misfeasance or breach of trust, as the court thinks fit.
124. Lorsque dans le cours de la liquidation des affaires d’une compagnie sous l’autorité de la présente loi, il apparaît qu’un administrateur, gérant, liquidateur, séquestre, dirigeant ou employé de cette compagnie, ancien ou actuel, a détourné ou gardé entre ses mains des deniers de la compagnie, ou en est devenu responsable ou comptable, ou s’est rendu coupable de prévarication ou d’abus de confiance à l’égard de la compagnie, le tribunal peut, à la demande d’un liquidateur, ou d’un créancier ou d’un contributeur de la compagnie, bien que l’infraction rende le délinquant responsable criminellement, faire enquête sur sa conduite. (viii) Upon termination of the Investment Account prior to liquidation of the Fund, a portion of the assets held in this account corresponding to the proportion of the assets transferred to this account under Article V, Section 12(g) to the total of the assets transferred to the account shall be transferred to the Special Disbursement Account if it has not been terminated, and the balance of the assets held in the Investment Account shall be transferred to the General Resources Account for immediate use in operations and transactions.

(2) The Minister of Finance shall pay into the Superannuation Account all moneys paid to him pursuant to subsection (1) and shall liquidate all securities transferred to him pursuant to subsection (1) and pay the moneys realized from such liquidation into the Superannuation Account on or before September 30, 1973.
