Before the entry into force of the Lisbon Treaty, investment was a policy field with a specific division of work between the EU and its Member States. Their roles in shaping investment policies were complementary: whilst the EU pursued the liberalisation of foreign direct investment, in particular through its trade agreements with non-EU countries, the Member States used to seek the protection of investment flows, by concluding Bilateral Investment Treaties.

On 12 June 2007, one cooperating Chinese exporting producer, namely Foshan Shunde Yongjian Housewares and Hardware Co. Ltd (‘Foshan Shunde’), lodged an application at the General Court (‘the Court of First Instance’ before the entry into force of the Lisbon Treaty) seeking the annulment of Regulation (EC) No 452/2007 in so far as it applies to the appellant (3).

The proposed regulation seeks to ensure a smooth transition from the current system of Bilateral Investment Treaties (BITs) between member states and third countries to future EU BITs to be negotiated by the Commission under the new Union competence for foreign direct investment, introduced by Article 207 of the Lisbon Treaty as part of the common commercial policy.

The European Council concluded its discussion of the question of enlargement at its Lisbon meeting on 26 and 27 June 1992 with the following observations relating to the EFTA countries: "The European Council considers that the EEA Agreement has paved the way for opening enlargement negotiations with a view to an early conclusion with EFTA countries seeking membership of the European Union .The official negotiations will be opened immediately after the Treaty on European Union is ratified and agreement has been achieved on the Delors II package". In the light of the decisions taken by the European Council at its Edinburgh meeting on 11 and 12 December 1992, enlargement negotiations got under way in February 1993 with Austria, Finland and Sweden, and in April 1993 with Norway.

Suite aux décisions prises au Conseil européen d'Edimbourg (11-12 décembre 1992 les négociations d'élargissement ont débuté en février 1993 avec l'Autriche, la Finlande et la Suède et en avril 1993 avec la Norvège.
