(16) Any Member State should be able to derogate from the responsibility criteria, in particular for humanitarian and compassionate reasons, and examine an application for international protection lodged with it or with another Member State, even if such examination is not its responsibility under the binding criteria laid down in this Regulation, provided that the Member State concerned and the applicant agree thereto.

Thus for example Article 6(5) of the Convention is not applied to the proposal for a directive at all (the purpose of this article being to encourage applicants for development consent to enter into dialogue with the public and to make information available to the public about the objectives of their application even before the application is lodged with the authorities). The Commission’s approach is defensible, but in some cases it will not be to the advantage of the authorities.
