(2) Where a consent has been given under subsection (1) to Her Majesty in right of a government other than the Government of Canada or to a co-belligerent of Her Majesty, if an undertaking by Her Majesty in right of the said government or by the said co-belligerent is given to Her Majesty in right of Canada to bear all expenses in connection therewith, the Court may order that any ship, aircraft or goods taken as prize under the authority of Her Majesty in right of the said government, or of the said co-belligerent, within, or so taken and brought within Canada or the territorial waters of Canada, be held in the custody of the Court until an order is made by a prize court constituted by or under the authority of Her Majesty in right of the said government or of the said co-belligerent with regard to the release or disposal thereof.

(3) Without limiting or restricting the authority of the Court otherwise to receive or to admit evidence, where Her Majesty in right of a government other than the Government of Canada or a co-belligerent of Her Majesty has given the consent referred to in subsection (1), the Court may receive evidence in respect of the taking as prize under the authority of Her Majesty in right of Canada, of any ship, aircraft or goods taken within, or so taken and brought within, the territory or territorial waters of Her Majesty in right of the said government or of the said co-belligerent, or in respect of any other matters of prize relating thereto, received and recorded by a prize court constituted by or under the authority of Her Majesty in right of the said government or of the said co-belligerent if the evidence would be received and admissible in the Court if given before it.

Instructs its President to forward this resolution to the Council, the Commission, the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy, the European External Action Service, the UN Secretary-General, the UN High Commissioner for Human Rights, His Majesty King Salman bin Abdulaziz, the Government of the Kingdom of Saudi Arabia, and the Secretary-General of the Centre for National Dialogue of the Kingdom of Saudi Arabia.

``13.1 (1) No transaction that is made by the Minister or CN at any time before the first day that more than fifty percent of the shares in CN are owned by parties other than Her Majesty in right of Canada (a) that would transfer to Her Majesty in right of Canada any part, subsidiary, operation or property of CN with a value exceeding one million dollars, or (b) that would transfer to a party other than Her Majesty in right of Canada any part, subsidiary, operation or property of CN with a value exceeding ten million dollars, shall be entered into unless (c) the Minister has referred the matter to the Auditor General of Canada, and (d) the Auditor General has reviewed the transaction and prepared and caused to be laid before the House of Commons, a report stating that, in the opinion of the Auditor General, the transaction is in the interest of CN and of Canada (2) The Auditor General shall cause the report to be laid before the House of Commons within fifteen days after the date of referral by the Minister'.

' Motion No. 9 That Bill C-89 be amended by adding after line 36, on page 7, the following new Clause: ``13.1 No transaction that is made by the Minister or CN at any time before the first day that more than fifty percent of the shares in CN are owned by parties other than Her Majesty in right of Canada (a) that would transfer to Her Majesty in right of Canada any part, subsidiary, operation or property of CN with a value exceeding one million dollars, or (b) that would transfer to a party other than Her Majesty in right of Canada any part, subsidiary, operation or property of CN with a value exceeding ten million dollars, shall be entered into until (c) the Minister has laid before the House of Commons a proposal that the transaction be entered into, (d) the proposal has been referred to such committee as the House may determine, (e) the committee has reported that it approves of the proposal, and (f) the House has concurred in the report of the committee'.
Motion no 9 Qu'on modifie le projet de loi C-89, par adjonction, après la ligne 34, page 7, du nouvel article suivant: «13.1 Avant que plus de cinquante pour cent des actions du CN ne soient devenues la propriété de personnes autres que Sa Majesté du chef du Canada, le ministre ne peut procéder à aucune opération qui aurait pour effet: a) soit de transférer à Sa Majesté du chef du Canada quelque partie, filiale, entreprise ou bien du CN dont la valeur dépasse un million de dollars, b) soit de transférer à une personne autre que Sa Majesté du chef du Canada quelque partie, filiale, entreprise ou bien du CN dont la valeur dépasse dix millions de dollars, à moins que les conditions suivantes ne soient remplies: c) le ministre a déposé devant la Chambre des communes une proposition de permettre la réalisation de l'opération; d) la proposition a été déférée au comité de la Chambre désigné par elle; e) le comité a fait rapport qu'il approuve la proposition; f) la Chambre des communes a agréé le rapport du comité».
