In the case of devices falling within Class III and implantable and long-term invasive devices falling within Class IIa or IIb, the manufacturer may commence the relevant clinical investigation at the end of a period of 60 days after notification, unless the competent authorities have notified him within that period of a decision to the contrary based on considerations of public health or public policy.

Member States may however authorise manufacturers to commence the relevant clinical investigations before the expiry of the period of 60 days, insofar as the relevant ethics committee has issued a favourable opinion on the programme of investigation in question, including its review of the clinical investigation plan.

Yet the indications are that these obstacles can quickly be overcome and it is encouraging that Alstom, in May 2008, became the first major manufacturer to state that CCS-equipped generating plants would be commercially available from 2015 so long as work commences shortly on the proposed demonstration projects that will help us learn-by-doing, testing technologies and reducing costs.

Il est encourageant qu'Alstom ait été le premier grand industriel à déclarer en 2008 que les centrales de production équipées pour le CSC seraient disponibles à partir de 2015 si les travaux débutent à bref délai sur les projets de démonstration proposés. Ces derniers permettront de tirer des leçons pratiques, tester les technologies et réduire les coûts.

5. Without prejudice to paragraph 6, written authorisation may be required before the commencement of clinical trials for such trials on medicinal products which do not have a marketing authorisation within the meaning of Directive 65/65/EEC and are referred to in Part A of the Annex to Regulation (EEC) No 2309/93, and other medicinal products with special characteristics, such as medicinal products the active ingredient or active ingredients of which is or are a biological product or biological products of human or animal origin, or contains biological components of human or animal origin, or the manufacturing of which requires such components.
