3. For the purposes of applying subparagraphs (a) and (b) of paragraph 1 to a company that is a resident of Canada, tax payable in Turkey shall include any tax which would have been payable in Turkey in respect of profits attributable to an active business carried on in Turkey for a taxation year, but for an exemption from or reduction of tax granted for that year, or any part thereof, under special tax measures in Turkey insofar as such measures were in force on, and have not been modified since, the date of signature of the Agreement or have been modified only in minor respects so as not to affect their general character.

Is the Commission prepared to introduce measures against Turkey unless that country ends its embargo on ships and aircraft which are in any way associated with the Republic of Cyprus or fly its flag?

It is significant because, despite Turkey being a country which has had some difficulties in this area – I confess, Mr President, that in the committee we heard about this problem, this difficulty in getting the idea accepted within Europe, the Europe which is so open to culture, as the various speakers have been saying all afternoon in their speeches on the four somewhat interconnected measures.

The Community recalls that according to the Customs Union in force between the Community and Turkey, this country has the obligation, in relation to countries which are not members of the Community, to align itself on the Common Customs Tariff and, progressively, with the preferential customs regime of the Community, taking the necessary measures and negotiating agreements on mutually advantageous basis with the countries concerned.

Despite the economic and social context, in which there is large- scale unemployment in the Community (16.75 million, i.e. 12.4 % of the Community of Twelve's labour force) and an improvement in Turkey's economic situation, with an average growth of 4.4 % in 1980-1985, resulting in unemployment figures which are no longer very different from the Community's, the Commission proposes the following : - 2 - * the consolidation and imporvement of the status of Turkish workers and their families legally resident in the Community, mainly by eliminating the discrimination which still exists as regards living and working conditions. * the establishment of conditions governing access to the labour market of a Member State for Turkish workers provided there are jobs available and with priority being given to the employment of nationals of the Member States. * measures to ensure that families can be reunited, in order to protect family life and enable parents to meet their obligations as regards education. These measures also take into account the situation of Greek, Spanish and Portuguese workers in the Community. The exercise of their right to freedom of movement will be limited until 1987 in the case of Greek workers and 1992 (*) in the case of workers from the two new Member States. Under the Additional Protocol to the Association Agreement, Turkish workers may not enjoy more favourable treatment thant the workers from the Member States (*) 31 December 1995 for Luxembourg - 3 - AIDE-MEMOIRE Present status of Turkish workers in the Community On the basis of the Ankara Agreement, the Association Council decided in 1976 that, for an initial period of four years, the Member States would give priority to Turkish workers if Community labour was not available. In June 198O, the Association Council decided to imporve on thses arrangements : after three years of legal employment in a Member State, the Turkish worker may apply for a job in the same trade or profession and enjoy free ...

Ces mesures prennent egalement en compte la situation dans la Communaute des travailleurs grecs, espagnols et portugais. En effet, conformement au Protocole additionnel de l'Accord d'Association, les travailleurs turcs ne peuvent pas beneficier d'un traitement plus favorable que celui qui est reserve aux travailleurs des Etats-membres. Sur la base de l'Accord d'Ankara, le Conseil d'Association a decide en 1976 que les Etats-membres s'efforceraient d'accorder une priorite aux travailleurs turcs lorsque les besoins en main-d'oeuvre ne pourraient etre satisfaits par les travailleurs communautaires (*) Le Conseil d'association en juin 1980, a decide d'apporter des ameliorations a ce regime : le travailleur turc a la possibilite apres trois ans d'emploi regulier dans un Etat membre, de postuler a un emploi dans la meme profession et beneficier du libre acces a toute activite salariale apres 4 ans. D'autre part, une cooperation est prevue en faveur des travailleurs turcs et de leurs familles dans les domaines socio-culturels, de la formation professionnelle et de l'echange des jeunes travailleurs. De plus, ce meme Conseil d'Association de juin 1980 a decide que les travailleurs turcs et les membres de leurs familles dans la Communaute pourraient beneficier de l'egalite de traitement avec les travailleurs communautaires, notamment en ce qui concerne les remunerations, les prestations de maladie, de vieillesse, d'invalidite et de chomage.

In more precise terms, the Commission advocated completion by Turkey of the customs union (with regard to industrial products) by 1 January 1996. This meant that Turkey would have to eliminate not only all the customs duties which it applied to imports from the EU, but also charges with equivalent effect, and that it would have to abandon export subsidies and other measures which jeopardized fair competition.
La Commission se déclare favorable, plus particulièrement, à l'achèvement, par la Turquie, de l'union douanière pour les produits industriels au 1er janvier 1996, ce qui suppose la suppression non seulement de tous les droits de douane applicables aux importations effectuées de l'UE mais aussi l'élimination de différentes taxes d'effet équivalent et l'abandon des subventions à l'exportation et d'autres mesures portant préjudice à une concurrence loyale.

The Council welcomed the recent opening of negotiations with Egypt and noted with great interest that the Commission was planning to submit proposals in the near future for opening negotiations with Jordan (b) The Council noted that there was agreement subject to confirmation on the general political framework for developing future relations between the European Union and Turkey (creation of a customs union and other areas of cooperation) and with Cyprus (message on the opening of accession negotiations) (c) The Commission submitted the report of the European observer for Cyprus (d) With more specific reference to Turkey, the Council noted a very broad measure of agreement on the various specific questions concerning the position to be taken by the Community at the next EC-Turkey Association Council meeting to be held at the time of the Council meeting on 6 and 7 March 1995, at which the aim was to conclude discussions on setting up a customs union with Turkey and on the development of other areas of cooperation, political dialogue and the resumption of financial cooperation.
Le Conseil s'est félicité de l'ouverture récente des négociations avec l'Egypte et a pris note avec grand intérêt de l'intention de la Commission de lui soumettre prochainement des propositions en vue de l'ouverture de négociations avec la Jordanie. b) Le Conseil a constaté un accord ad referendum sur le cadre politique général pour le développement des relations futures entre l'Union européenne et la Turquie d'une part - réalisation de l'union douanière et autres domaines de la coopération - et Chypre d'autre part - message sur l'ouverture des négociations d'adhésion. c) La Commission a présenté au Conseil le rapport de l'observateur européen sur Chypre. d) S'agissant plus particulièrement de la Turquie, le Conseil a constaté un très large accord sur les différentes questions spécifiques concernant la position à prendre par la Communauté lors du prochain Conseil d'Association CE-Turquie qui se tiendra en marge de la session du Conseil des 6 et 7 mars 1995 et qui est destinée à parachever les travaux en vue de la réalisation de l'union douanière avec la Turquie, ainsi que du développement des autres domaines de coopération, du dialogue politique et de la reprise de la coopération financière.
