Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from the criminal record between Member States (the ‘Framework Decision’ or ‘FD’) aims to address these shortcomings by stipulating that information on any EU citizen’s previous convictions by any criminal court in the EU is available to all Member State courts and law-enforcement authorities for criminal proceedings in the pre-trial and trial stages and the execution of the conviction.By imposing a series of obligations on the convicting Member State and the Member State of nationality, the Framework Decision ensures that each Member State can provide exhaustive and complete information in relation to the criminal records of its nationals upon request by another Member State.
La décision-cadre 2009/315/JAI du Conseil concernant l’organisation et le contenu des échanges d’informations extraites du casier judiciaire entre les États membres (ci-après la «décision-cadre») vise à combler ces lacunes en prévoyant que pour les besoins de procédures pénales, à savoir lors de la phase préalable au procès pénal, lors du procès pénal lui-même ou de la phase d’exécution de la condamnation, toutes les juridictions et autorités de police des États membres ont accès aux informations sur les condamnations antérieures de tout citoyen de l’Union prononcées par une juridiction pénale siégeant dans l’UE. 3. Once the time limit set out in Article 11(7) has elapsed, whenever a person asks the central authority of a Member State other than the Member State of the person’s nationality for information on his own criminal record, the central authority of the Member State in which the request is made shall submit a request to the central authority of the Member State of the person’s nationality for information and related data to be extracted from the criminal record in order to be able to include such information and related data in the extract to be provided to the person concerned.
3. In addition to the obligations of a convicting Member State to transmit information to the Member States of the person’s nationality concerning convictions handed down against their nationals which this Framework Decision incorporates and further defines, an obligation on the Member States of the person’s nationality to store information so transmitted is also introduced, in order to ensure that they are able to reply fully to requests for information from other Member States.
Outre les obligations incombant à l'État membre de condamnation concernant la transmission à l'État membre de nationalité des informations relatives aux condamnations prononcées à l'encontre de ses ressortissants, qu'elle reprend et précise, la présente décision-cadre prévoit aussi une obligation pour l'État membre de nationalité de conserver ces informations transmises, afin qu'il soit en mesure d'apporter une réponse complète aux demandes d'informations qui lui seraient adressées par d'autres États membres.

The Council: 1. reaffirms the importance of reinforcing coordination in development cooperation between the Community and the Member States as stated in Article 130x of the Treaty on European Union and in accordance with the principle of complementarity of policies set out in Article 130u; 2. notes with interest the initial results of reinforced coordination in the six pilot countries, in particular the progress made in several countries in reciprocal exchange of information between the representatives of the Member States and the Community and the consequent greater transparency of sectoral and regional activities of the Commission and Member States; 3. notes, however, the disparity between one country and another in the functioning of coordination and observes that the process is hindered by a number of problems relating, inter alia, to lack of staff, links with other coordination bodies and the involvement of beneficiary countries; 4. also emphasizes, in view of the differing economic and social situations in the various countries, the advantages of coherent analysis and exchange of information between the Member States and the Commission; 5. stresses the importance of Community coordination and reiterates the main objectives, which are: to strengthen the capacity of the recipient country to assume responsibility for and ownership of its own development strategies and programmes; to reduce the administrative burden on beneficiary countries with the aim of encouraging strengthened capacity; to increase the effectiveness of development cooperation by the Community and its Member States and providers of funds as a whole; to ensure consistency of the cooperation activities of the Community and its Member States with the common political guidelines adopted by the Council and to ensure complementarity of the various measures within the framework of a single strategy developed by the beneficiary country itself; to optimize the European Union's presence in develo ...
