Taking account of the evolution of terrorist threats to and legal obligations on the Union and Member States under international law, the definition of terrorist offences, of offences related to a terrorist group and of offences related to terrorist activities should be further approximated in all Member States, so that it covers conduct related to, in particular, foreign terrorist fighters and terrorist financing more comprehensively.
Compte tenu de l’évolution des menaces terroristes et des obligations juridiques incombant à l’Union et aux États membres en vertu du droit international, il convient de rapprocher encore, dans tous les États membres, les définitions d’infractions terroristes, d’infractions liées à un groupe terroriste et d’infractions liées à des activités terroristes, de façon à couvrir de manière plus complète les comportements liés, en particulier, aux combattants terroristes étrangers et au financement du terrorisme.

Draws attention to the fact that displacement due to conflicts, natural disasters or environmental degradation leaves certain populations particularly vulnerable; stresses that refugees, internally displaced persons, victims of trafficking and other migrants caught in crises that endanger their lives must be afforded suitable protection of their human rights; expresses its deep concern regarding the unprecedentedly high number of refugees, externally displaced persons and migrants in the world today, and calls on the global community to use the World Humanitarian Summit to mobilise the necessary financial and operational resources to meet this challenge by specifically focusing on its root causes; highlights the importance of interreligious and intercultural dialogues in tackling massive refugee flows; calls on the EU and its Member States to prioritise the global refugee crisis in its policies and positions regarding the Summit, with a view to tackling the consequences of, and underlying reasons for, this flood of refugees; with this in view, urges the World Humanitarian Summit to call for more efficient ways to combat human trafficking and clamp down on recruitment and funding for terrorist groups by preventing and suppressing the recruiting, organising, transporting, and equipping of terrorist fighters, and the financing of their travel and activities; underlines the necessity and importance of rapid action together with a long-term concrete and comprehensive action plan to be applied in cooperation with third countries and local, national and regional actors for an effective and efficient approach with regard to the organised criminal networks of migrant smugglers; notes that Article 14(1) of the Universal Declaration of Human Rights guarantees the right to seek and enjoy asylum, and stresses the obligation of states not to practise refoulement towards refugees; stresses the need for the EU, its Member States and all international actors to comply ful ...

Supports measures aimed at weakening terrorist organisations from the inside and lessening their current influence on EU citizens and non-EU nationals legally residing in the EU; urges the Commission and the competent agencies to look into ways of dismantling terrorist networks and identifying how they are funded; to this end, calls for better cooperation between the Financial Intelligence Units of the Member States and for the speedy transposition and implementation of the Anti-Money Laundering Package; encourages the Commission to propose a regulation on identifying and blocking terrorism funding channels and countering the ways in which they are funded; calls on the Commission, therefore, to re-evaluate the creation of a common European terrorist finance tracking system; encourages Member States to implement the highest standards of transparency concerning access to information on beneficiary owners of all corporate structures in the EU and in opaque jurisdictions which may be vehicles for financing terrorist organisations;

Believes that measures aimed at preventing the radicalisation of European citizens and their recruitment by terrorist organisations will not be fully effective until they are accompanied by an effective, dissuasive and articulated range of criminal justice measures in all Member States; considers that through effectively criminalising terrorist acts carried out abroad with terrorist organisations the Member States will equip themselves with the tools needed to eliminate terrorist radicalisation among European citizens while making full use of the existing EU police and judicial cooperation tools in criminal matters; considers that law enforcement and justice authorities (judges and prosecutors) should have sufficient capacity to prevent, detect and prosecute those acts, and should be adequately and continuously trained on terrorism-related crimes;

Calls on the EU and its Member States to address the root causes of the rapidly deteriorating situation across the MENA region through a holistic and ambitious approach; supports the international campaign against ISIL/Da’esh and welcomes the commitment of the coalition partners to working together under a common strategy; welcomes, in particular, the action taken by the EU Member States participating in the international coalition against ISIS, whether in the form of military strikes or through logistical, financial and humanitarian participation; calls, however, for increased mobilisation in all spheres and emphasises the need for better-articulated actions; notes that these actions could usefully be coordinated under the auspices of the EU, if necessary as part of a Common Security and Defence (CSDP) operation, and to this end calls on the EU to develop sufficient operational capacity and to put in place a true common European defence; stresses, however, that a tailored response must be found, based on political and cross-regional differences, to the issue of combating ISIL/Da’esh, the al-Nusra Front and other terrorist groups; calls on the EU to take on the role of main facilitator of a regional dialogue involving all regional stakeholders, in particular the LAS, Saudi Arabia, Egypt, Turkey and Iran; recalls the importance of addressing the legitimate demands of local populations, notably as expressed during the Arab uprisings of 2011, with a view to ensuring the long-term stability of the region; notes the recent announcement by the LAS of the formation of a standing rapid-response unit, with a particular emphasis on fighting ISIS and other emerging terrorist groups;

6. Each Member State shall take the necessary measures to ensure that relevant information gathered by its competent authorities in the framework of criminal proceedings in connection with terrorist offences is made accessible as soon as possible to the competent authorities of another Member State where the information could be used in the prevention, detection, investigation or prosecution of terrorist offences as referred to in Directive (EU) 2017/541, in that Member State, either upon request or spontaneously, and in accordance with national law and relevant international legal instruments.
6. Regarding penalties, it introduces a principle of "aggravating circumstance" by providing that "terrorist offences" and certain offences linked to terrorism must be punishable by custodial sentences heavier than those imposable under national law for such offences in the absence of a terrorist intent, it sets the minimum level of the maximum penalty at 15 years for directing a terrorist group and 8 years for participation in a terrorist group, it enumerates a series of penalties that can be imposed on bodies corporate (in particular exclusion from entitlement to public benefits or aid, temporary or permanent disqualification from the practice of commercial activities, placing under judicial supervision, judicial winding-up order and closure of establishments), it provides for a system of "repentis" by providing for specific circumstances in which Member States may reduce prison sentences where the terrorist renounces terrorist activity or provides the administrative or judicial authorities with information.
S'agissant des sanctions, elle introduit un principe de "circonstance aggravante" en prévoyant que les "infractions terroristes" et certaines infractions liées au terrorisme doivent être passibles de peines privatives de liberté plus sévères que celles prévues par le droit national lorsqu'elle sont commises en dehors d'un contexte terroriste, elle fixe le seuil minimal des peines privatives de liberté maximales encourues à 15 ans pour la direction d'un groupe terroriste et à 8 ans pour la participation à un groupe terroriste, elle énumère un certain nombre de sanctions dont peuvent être passibles les personnes morales (En particulier des mesures d'exclusion du bénéfice d'un avantage ou d'une aide public, l'interdiction d'exercer une activité commerciale, le placement sous surveillance judiciaire, la dissolution et la fermeture d'établissement), elle prévoit un système de "repentis" en intègrant des circonstances particulières permettant aux Etats membres de réduire les peines d'emprisonnement lorsque le terroriste renonce à ses activités ou fournit certaines informations aux autorités administratives ou judiciaires.

In the other Member States considered here, the technique used to define terrorist offences raises some concerns: Luxembourg does not foresee a catalogue of terrorist offences, Slovenia uses only a general definition of terrorist offences, Lithuania appears to lack a complete definition and Poland only defines terrorist intent.
Dans les autres États membres examinés, le mode de définition des infractions terroristes suscite certaines préoccupations: le Luxembourg ne prévoit pas de liste des infractions terroristes, la Slovénie n'emploie qu'une définition générale de celles-ci, la Lituanie semble ne pas avoir de définition complète et la Pologne ne définit que l'intention terroriste.

Persons who participate in the financing, planning, preparation or perpetration of terrorist acts or in supporting terrorist acts shall be brought to justice; such terrorist acts shall be established as serious criminal offences in laws and regulations of Member States and the punishment shall duly reflect the seriousness of such terrorist acts.
Les personnes qui participent au financement, à l'organisation, à la préparation ou à la perpétration d'actes de terrorisme ou qui y apportent un appui sont traduites en justice; ces actes de terrorisme sont érigés en crimes graves dans la législation et la réglementation des États membres et la peine infligée est à la mesure de la gravité de ces actes.
