Upon a request from Commissioner Van Miert the Austrian government provided the Commission with detailed information on the tendering procedure in August which is currently analysed by the Commission's services.

The Austrian Government had decided to ban, with effect from 1 December, all lorries whose sound-emission levels exceed 80 decibels from Austrian roads between the hours of 10 pm and 5 am. The Community's Transport Ministers had asked Mr Van Miert to seek meetings at the highest political level, within the framework of negotiations between the EEC and the Alpine countries, to limit the damage to the operation of the common market caused by the Austrian restrictions.
Il est rappelé que le gouvernement autrichien a décidé d'interdire à partir du premier décembre 1989 de 10 du soir à 5 h du matin la circulation sur les routes autrichiennes de camions dont le niveau d'émission sonore dépasse 80 décibels. Dans le contexte des négociations entre la CEE et les pays alpins les ministres du transport de la Communauté avaient demandé à M. Karel Van Miert d'avoir des contacts au plus haut niveau politique en vue de réduire les conséquences négatives des restrictions autrichiennes pour le fonctionnement du marché commun.

On 12 November Mr Van Miert, Member of the Commission, sent Mr Streicher, the Austrian Minister of Transport, a letter pointing out that the latest restrictions imposed by the Austrian government on traffic on the Inntal- Brenner motorway were not compatible with the agreement reached on 27 August between the Commission and the Member States most directly involved in transit traffic through Austria.
Le Commissaire Van Miert a adressé dès le 12 novembre une lettre à M. Streicher, Ministre autrichien des Transports, pour lui signaler que les nouvelles restrictions de trafic que le gouvernement autrichien venait d'instaurer sur l'autoroute Inntal-Brenner étaient incompatibles avec l'accord intervenu le 27 août entre la Commission, les Etats membres directement concernés par le transit et l'Autriche.

In his concern to find a solution to the transit problem that goes beyond the mere suspension of the Italian Ministerial decree, Mr Van Miert reminded the Minister that he was urging: - the Austrian Minister to show the greatest possible generosity towards the Italian request concerning the Austrian authorization system; and - the Member States to give their full support in view of the difficulties encountered by the Italian road hauliers due to the insufficiency of authorizations.
Le Commissaire, soucieux de ne pas limiter la solution du problème du transit à la seule suspension du décret ministériel italien, a rappelé qu'il insistait à nouveau : - auprès du Ministre autrichien pour qu'il fasse preuve de la plus grande générosité possible à l'égard de la demande italienne relative au régime d'autorisations autrichiennes, - auprès des Etats membres afin qu'ils témoignent d'une solidarité effective vis-à-vis de l'insuffisance d'autorisation de transit dont souffrent les transporteurs italiens.

Commission Member Van Miert restated that the Community was ready to participate, along with the Alpine transit countries, in the definition of a "clean lorry" which would make it possible to avoid the sort of measures taken by the Austrian Government.
