30. Welcomes the elections to the National Minority Councils of 26 October 2014; underlines the importance of National Minority Councils in their role of implementation of rights of national minorities, and calls on Serbia to ensure that the level of acquired rights and competences is retained in the process of their legal alignment with the decision of the Constitutional Court of Serbia, as well as for their adequate and ascertainable financing; calls on Serbia to ensure consistent implementation across the country of legislation on protection of minorities, including in relation to education, use of languages, and access to the media and religious services in minority languages, and adequate representation of national minorities in public administration, local and regional bodies, as well as in the national parliament; encourages Serbia’s commitment in drafting a specific action plan on the position of national minorities in the framework of the Action Plan for Chapter 23; encourages the Serbian authorities to take further measures to improve the situation of the Roma, particularly when it comes to education, housing and employment; urges the government to increase awareness of civil rights among the Roma population and also to offer equal safety protection for the Roma; stresses the importance of encouraging the Roma to take part in public life; calls on the Serbian authorities to improve the planning, coordination and monitoring of implementation of Roma inclusion policies and actions at national and local level;

Considers that no single solution exists for improving the situation of such minorities in all the Member States, but that some common and minimum objectives for public authorities in the EU should be developed, taking account the relevant international legal standards and existing good practices; calls on the Member States to ensure that their legal systems guarantee that persons belonging to a recognised national minority will not be discriminated against, and to adopt adequate measures to promote effective equality, based on the relevant international norms and good practice, inter alia the Council of Europe Framework Convention for the Protection of National Minorities; calls on the Commission to establish a policy standard for the protection of national minorities, including indigenous, traditional ethnic and linguistic minority communities, bearing in mind that they comprise more than 10 % of the total population of the EU, in order to avoid applying double standards that differentiate between candidate countries and Member States; stresses the need for a comprehensive EU protection system for traditional national minorities, regional linguistic groups and constitutional regions accompanied by a functioning monitoring mechanism, following the example of the EU Framework for National Roma Integration Strategies; calls on the Member States to provide comprehensive data on violations of the fundamental rights of minorities, so as to allow the FRA and the EU to ensure data collection and reporting;
57. estime qu'il n'existe pas de solution unique pour améliorer la situation de ces minorités dans tous les États membres mais qu'une série d'objectifs communs minimaux devraient être définis à l'intention des pouvoirs publics de l'Union, en tenant compte des normes internationales applicables et des bonnes pratiques; invite les États membres à s'assurer que leur ordre juridique garantisse qu'aucune discrimination ne puisse être opérée au détriment des personnes appartenant à une minorité nationale reconnue et à adopter des mesures appropriées pour promouvoir une égalité effective fondée sur les normes internationales et les bonnes pratiques pertinentes, entre autres la convention-cadre du Conseil de l'Europe sur la protection des minorités nationales; invite la Commission à établir une norme pour la protection des minorités nationales, y compris les minorités autochtones, traditionnelles, ethniques et linguistiques, compte tenu qu'elles représentent plus de 10 % de l'ensemble de la population européenne, afin d'éviter les inégalités de traitement entre les pays candidats à l'adhésion et les États membres de l'Union; souligne la nécessité de mettre en place un système de protection complet à l'échelle de l'Union européenne pour les minorités nationales traditionnelles, les groupes linguistiques régionaux et les régions constitutionnelles, assorti d'un mécanisme de suivi fonctionnel, à l'exemple du cadre européen pour les stratégies nationales d'intégration des Roms; invite les États membres à communiquer des statistiques précises sur les violations des droits fondamentaux des minorités, qui seront rassemblées et analysées par la FRA et l'Union européenne;

29. Calls for the effective implementation of the legislation and bilateral and multilateral agreements on national and ethnic minorities in an equal, non-discriminatory and proportional manner throughout the country; calls on the authorities to promote a climate of tolerance and equal treatment, without any discrimination against national and ethnic minorities, including access to education in the mother tongue, and use of languages in local and regional public administration; calls also for improvements in order to eliminate discrimination in existing laws and practices concerning property restitution for members belonging to national and ethnic minorities; underlines the importance of National Minority Councils, their role in the integration of national minorities such as in the implementation of the individual and collective rights of national minorities, and calls on the authorities to provide uninterrupted and adequate financial resources for their work; calls on the authorities to ensure a smooth electoral process for the 2014 election to the National Minority Councils, in line with the recommendations made by the independent bodies; expresses concern about the possible interruption of the broadcasting of programmes in minority languages because of the announced privatisation of the media;
29. demande que la législation et les accords bilatéraux et multilatéraux relatifs aux minorités nationales et ethniques soient appliqués dans les faits, ce de façon égale, non discriminatoire et proportionnelle dans l'ensemble du pays; demande aux autorités de promouvoir un climat de tolérance et d'égalité de traitement, sans aucune discrimination à l'encontre des minorités nationales et ethniques, en garantissant l'accès à l'enseignement en langue maternelle et l'utilisation des langues dans les administrations publiques locales et régionales; appelle également de ses vœux des améliorations afin d'éliminer les discriminations dans les lois et usages en vigueur en matière de restitutions pour les membres de minorités nationales et ethniques; insiste sur l'importance des conseils des minorités nationales, souligne le rôle qu'ils jouent dans l'intégration des minorités nationales et notamment dans la mise en œuvre des droits individuels et collectifs des minorités nationales, et invite les autorités à leur procurer sans interruption des moyens financiers suffisants pour leur permettre de mener leurs activités; invite les autorités à garantir le déroulement sans heurts du processus électoral relatif à l'élection des conseils des minorités nationales qui se tiendra en 2014, conformément aux recommandations formulées par des organismes indépendants; exprime son inquiétude face à l'éventualité d'une interruption des émissions réalisées dans les langues des minorités qui pourrait faire suite à la privatisation annoncée des médias;

Interventions in this area shall aim at: establishing independent, accountable and efficient judicial systems, including transparent and merit-based recruitment, evaluation and promotion systems and effective disciplinary procedures in cases of wrongdoing; ensuring the establishment of robust systems to protect the borders, manage migration flows and provide asylum to those in need; developing effective tools to prevent and fight organised crime and corruption; promoting and protecting human rights, rights of persons belonging to minorities — including Roma as well as lesbian, gay, bisexual, transgender and intersex persons — and fundamental freedoms, including freedom of the media.
Les interventions dans ce domaine visent à mettre en place un appareil judiciaire indépendant, responsable et efficace, reposant notamment sur des systèmes de recrutement, d'évaluation et de promotion transparents et fondés sur le mérite et sur des procédures disciplinaires opérantes en cas de faute; assurer la mise en place de systèmes solides pour protéger les frontières, gérer les flux migratoires et accorder l'asile aux personnes qui en ont besoin; se doter d'instruments efficaces pour prévenir et combattre la criminalité organisée et la corruption; défendre et protéger les droits de l'homme, les droits des personnes appartenant à des minorités — y compris les Roms ainsi que les personnes lesbiennes, gays, bisexuelles, transsexuelles et intersexuées — et les libertés fondamentales, y compris la liberté des médias.

42. Notes with regret that the Republican Council for National Minorities has not been active since 2009; calls on the authorities to facilitate in good faith the formation of the Bosniak National Council, as well as the integration of the two Islamic Communities in the country; draws attention to the fact that Sandžak and South and South-East Serbia, where a significant number of minorities live, are economically underdeveloped regions which require further efforts by the authorities to combat high unemployment and social exclusion; reiterates the importance of implementation of the protocol on national minorities signed by the Romanian and Serbian governments in Brussels on 1 March 2012; calls on the Serbian authorities to improve the situation of all minorities, including Roma, Bosniak, Albanian and Bulgarian minorities, which are disproportionally affected by the economic downturn, and to ensure consistent application of the legal framework on the protection of minorities throughout Serbia, notably in the areas of education, language and cultural rights; regrets the recent incidents in Vojvodina involving attacks on ethnic minorities; calls, therefore, on the authorities, particularly the forces of law and order, to investigate all details of the cases concerned;

In order to provide for supplementary rules, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of family members, siblings or relatives of an unaccompanied minor; the criteria for establishing the existence of proven family links; the criteria for assessing the capacity of a relative to take care of an unaccompanied minor, including where family members, siblings or relatives of the unaccompanied minor stay in more than one Member State; the elements for assessing a dependency link; the criteria for assessing the capacity of a person to take care of a dependent person and the elements to be taken into account in order to assess the inability to travel for a significant period of time.

5. The Commission shall be empowered to adopt delegated acts in accordance with Article 45 concerning the identification of family members, siblings or relatives of the unaccompanied minor; the criteria for establishing the existence of proven family links; the criteria for assessing the capacity of a relative to take care of the unaccompanied minor, including where family members, siblings or relatives of the unaccompanied minor stay in more than one Member State.

La Commission est habilitée à adopter des actes délégués en conformité avec l’article 45 en ce qui concerne l’identification des membres de la famille, des frères ou sœurs ou des proches du mineur non accompagné; les critères permettant d’établir l’existence de liens familiaux avérés; les critères permettant d’évaluer la capacité d’un proche de s’occuper du mineur non accompagné, y compris lorsque les membres de la famille, les frères ou sœurs ou les proches du mineur non accompagné résident dans plus d’un État membre.
